ORDINANCE NO. 2025-002

AN ORDINANCE INSTITUTING AN ENGAGEMENT WITH THE 27 BARANGAYS OF NAGA IN THE MANAGEMENT, COLLECTION, AND DISPOSAL OF SOLID WASTES; APPROPRIATING FUNDS THEREFOR.

Explanatory Note

The Local Government Code expressly provides that the collection, management and disposal of solid waste is a responsibility of both the City and the Barangays. With this mandate, a system of partnership becomes necessary to ensure that solid wastes are efficiently managed and properly disposed; and that the people involved are given due recognition and reasonably compensated for contributing to a cleaner and greener Naga City.

Be it therefore ordained, by the Sangguniang Panlungsod, in session assembled, that:

SECTION 1. TITLE This ordinance shall also be known as the “Barangay Solid Waste Management Volunteers Ordinance of Naga City”.

SECTION 2. PURPOSE AND OBJECTIVE This Ordinance shall serve as basis for the City’s engagement of volunteers who will undertake activities relative to the management, disposal, and collection of solid wastes within their respective territories.

In addition, this ordinance aims to effectively devolve to the barangays, while assisting in its implementation, the mandates of the Ecological Solid Waste Management Act of 2000 or the R.A. 9003 thereby augmenting our efforts in making Naga City a cleaner and greener City, compliant with the standards of solid waste management as prescribed under pertinent laws and issuances of concerned Government agencies.

SECTION 3. LEGAL BASIS Section 458(5) (xiii) of the Local Government Code provides that the Sangguniang Panlungsod shall approve ordinances which shall ensure the effective and efficient delivery of basic services and facilities; and provide for an efficient and effective system of solid waste and garbage collection and disposal.

Furthermore, the Manual on Position Classification and Compensation issued by the DBM provides that higher local governments (such as the City Government of Naga) are not precluded to undertake projects in the barangay which may include the payment of honoraria to its volunteer workers.

SECTION 4. ENGAGEMENT OF VOLUNTEERS The engagement of Volunteers Workers who will assist in the solid waste management efforts of the City within their respective barangays shall be facilitated by the Solid Waste Management Office (SWMO) of the City Government of Naga which shall:

a. Identify the necessary number of volunteers required for each barangay depending on the Barangay’s population, area, and volume of solid waste collection, among other factors;
b. Coordinate jointly with the Punong Barangays and Barangay Kagawad Chairperson on Environment for the engagement of competent people and submit their names to the Solid Waste Management Office. The incumbent Barangay Environment Monitors of the 27 Barangays and/or other volunteer workers involved in solid waste management efforts shall have preference in the engagement;
c. Conduct the training and orientation of the engaged Barangay Volunteers on the proper management and collection of solid wastes in their respective barangays; and
d. Be responsible in preparing the Engagement Contracts of the Barangay Volunteers and facilitate the submission of accomplishment reports, daily time records, and other documents which may be necessary in the processing of their honoraria;
e. Provide for the tools, equipment, materials, safety apparatus, and other assistance which may be necessary for the performance of responsibility of the appointed volunteers;
f. Solicit the assistance of other City Government Offices, National Government Agencies, and NGOs to help ensure cleanliness of the Barangay surroundings which will be assigned to them;

SECTION 5. RESPONSIBILITIES OF THE VOLUNTEER WORKERS ON SOLID WASTE MANAGEMENT. The Barangay Solid Waste Management Volunteers, in coordination with the Punong Barangays and Chairpersons of the Committee on Environment, shall be the focal persons of the City Solid Waste Management Office in ensuring the:

a. Cleanliness and maintenance of barangay surroundings with major focus on roads, streets, drainage canals and existing bodies of water;
b. Compliance to and enforcement of waste segregation policies and the functionality of the barangay materials recovery facility (MRF);
c. Timely collection and transfer of recyclables to the Barangay’s MRF and the solid and other residual wastes from the community’s collection area to the City’s Sanitary Landfill; and
d. Effectiveness of waste composting efforts by coordinating with the SWMO in the conduct of trainings, seminars, and the distribution of information materials relative to proper solid waste management.

In addition, the Barangay Volunteer Workers shall be deputized to issue citation tickets to violators of City or Barangay Ordinances and other issuances and shall also be entitled to the appropriate incentives provided in City Ordinance 2004-046.

SECTION 6. HONORARIA AND INCENTIVES. The volunteers workers engaged under this ordinance shall be entitled to an Honoraria in the amount of Three Thousand (3,000.00) Pesos per month. In addition, the Solid Waste Management Office shall establish an awards and incentives scheme to annually recognize good performance and compliance of barangays and communities with pertinent environmental laws and issuances.

SECTION 7. MONITORING AND EVALUATION. The Solid Waste Management Board shall be on top of monitoring and evaluating the effective implementation of the provisions of this Ordinance. An Annual Report shall be submitted to the City Mayor and the Sangguniang Panlungsod not later than the first quarter of every year.

SECTION 7. FUNDING. The necessary funds for the implementation of this Ordinance shall be incorporated in the investment plan and budget of the Solid Waste Management Office and the City’s budget beginning FY 2026.

SECTION 8. SEPARABILITY CLAUSE. Should any portion of this ordinance be declared unconstitutional or invalid, the other parts which are not thereby affected shall remain in full force and effect.

SECTION 9. EFFECTIVITY. This ordinance shall be effected upon approval and publication.
