ORDINANCE NO. 2022-019 

ORDINANCE RELOCATING, EXPANDING AND UPGRADING THE NAGA CITY HOSPITAL TO ITS NEW LOCATION IN THE 33,199 SQUARE METER CITY-OWNED LOT LOCATED IN BARANGAY BALATAS, CITY OF NAGA, AND APPROPRIATING FUNDS THEREFORE AND FOR OTHER PURPOSES:-

EXPLANATORY NOTE

WHEREAS, the 1987 Constitution of the Republic of the Philippines declares that the State shall protect and promote the right to health of the people and instill health consciousness among them and, towards such policy declaration, Section 6 (General Welfare Clause) of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that local government units are mandated to ensure and support the promotion of health and safety of their constituents living within their territorial jurisdiction;

WHEREAS, the City Government of Naga recognizes that a stronger, more modern and bigger hospital is needed to fully address and support the increasing population of the City of Naga and to ensure that families and residents of this fair city, particularly those who belong to the underprivileged sectors, have better access to a wide range of health care services;

WHEREAS, the relocation, expansion and upgrading of the Naga City Hospital will contribute in accomplishing the State’s main goals by improving the health status of the constituents and providing affordable, quality and accessible health care services to all Nagueños;

WHEREAS, the expanded Naga City Hospital shall also be the home of the soon to be built city-owned and city-operated Naga City Dialysis Center and Naga City Physical Rehabilitation Center, and an initial of 55 bed capacity will be established in said hospital, with provision for increase in its bed capacity as the need arises in the future;

WHEREAS, the relocated, expanded and upgraded city hospital will bear the name Naga City Hospital II (NCMH 2) in support of the city’s efforts in preserving and enriching the history and culture of Naga as well as in recognizing the exemplary contributions and legacies of the present hospital in Barangay Peñafrancia in the development of our Maogmang Lugar;

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of Naga, in session duly-assembled, that:

SECTION 1. OFFICIAL NAME. There is a need to expand and upgrade the Naga City Hospital, as well as relocate it to its new location in the 33,199 square meter city-owned lot located in Barangay Balatas, City of Naga, and said upgraded hospital is hereby officially named as “Naga City Medical Hospital II (NCHM 2)”.

SECTION 2. PURPOSE. The primary objective of this ordinance is to provide an adequate space to serve community healthcare needs, offer expanded services, provide high quality medical care, promote collaboration with medical practitioners and provide a venue for healthcare/educational institutions to train medical/healthcare students for them to become equipped with modern knowledge on medicine. The Naga City Medical Hospital II shall also practice collaborative partnership with healthcare professionals in order for them to have an extension of their community health service to the underprivileged.

SECTION 3. ORGANIZATIONAL STRUCTURE. The current Chief of Hospital (City Government Department Head I) of the Naga City Hospital and his present staff shall oversee the operations of NCHM 2.

SECTION 4. FUNDING. The funding for the construction of the medical hospital amounting to Five Hundred Million Pesos (P500,000,000.00) shall be sourced from the proceeds of city’s loan with the Development Bank of the Philippines (DBP) amounting to Three Hundred Fifty Million Pesos (P350,000,000.00) and the remaining balance shall be from other sources.

SECTION 5. IMPLEMENTING RULES AND REGULATIONS. The Chief of Hospital and the Local Health Board shall jointly formulate rules and regulations in order to fully implement the provisions of this Ordinance. To be drafted within 30 days after the approval of this Ordinance by the Sangguniang Panlungsod and by the City Mayor, the said IRR shall provide, among others, policies for efficient billing and collection of hospital charges and fees, proper assessment and classification of patient treatment services and adjustment of such rates, without need for further legislative action but only subject to review and oversight of operation.

SECTION 6. REPEALING CLAUSE. All Ordinances, Executive Orders or other issuances which are inconsistent or in conflict with the provisions of this Ordinance are hereby deemed amended, modified or repealed accordingly.

SECTION 7. SEPARABILITIY CLAUSE. Any provision of this Ordinance declared to be in conflict with the Constitution shall not impair the other parts thereof which shall remain in full force and effect.

SECTION 8. EFFECTIVITY. This Ordinance shall take effect immediately after publication in a newspaper of general circulation in the City of Naga.
