ORDINANCE NO. 2025-006

AN ORDINANCE AMENDING ORDINANCE NO. 95-069, ENTITLED, “AN ORDINANCE DECLARING ILLEGAL THE PUTTING OF OBSTRUCTIONS TO LINE AND GRADE SETBACKS FOR COMMERCIAL AND RESIDENTIAL BUILDINGS IN THE URBAN DISTRICT OF NAGA CITY AND PROVIDING PENALTIES THEREFORE”:

Be it ordained, by the Sangguniang Panlungsod, in session assembled, that:

SECTION 1. Section 4 of Ordinance No. 95-069 is hereby amended, now to read as follows:

SECTION 4. PENALTY. For the violation of the foregoing prohibition, the offender shall suffer the following:

1st Violation: Payment of Fine amounting to P1,000.00;

2nd Violation: Payment of Fine amounting to P3,000.00;

3rd & Succeeding Violation: Payment of Fine amounting to P5,000.00 and or imprisonment of no less than 30 days but not more than 6 months at the discretion of the court of non-payment of fine at the prescribed period.

If the violator is a firm or establishment, then the owner or manager shall be held liable for the violations.”

SECTION 2. Section 5 thereof is hereby amended, now to read as follows:

“SECTION 5. CONFISCATION. The Naga City Police Office (NCPO) and Public Safety Office (PSO) are given the authority to confiscate for safekeeping such obstructing materials or objects which are placed set up or provided on the grade set back which shall in any way impede the use of parking space.

Unclaimed materials or objects for the period of Ten (10) calendar days shall be included to the inventory of signage under the care of Traffic Management Center (TMC).”

SECTION 3. Additional Sections are hereby added thereto and numbered accordingly, now to read as follows:

“SECTION 6. REPEALING CLAUSE. All ordinances, rules, orders, and regulations or parts thereof which are contrary to or inconsistent with any of the provisions of this ordinance are hereby amended, repealed and/or modified accordingly;

SECTION 7. SEPARABILITY CLAUSE. If any provision of this ordinance or the application thereon to any person or circumstances is held invalid or declared unconstitutional, the remainder of this ordinance, and application of such provision to toehr persons or circumstances shall not be affected thereby;

SECTION 8. EFFECTIVITY. This ordinance shall take effect immediately upon its approval and publication in the Naga City Government pages and website or in a newspaper of local circulation.”
