ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 2019-013, ENTITLED “AN ORDINANCE AMENDING SECTION 9 OF ORDINANCE NO. 2018-007, ENTITLED “AN ORDINANCE STRENGTHENING THE KAANTABAY SA KAUSWAGAN PROGRAM OF THE CITY GOVERNMENT OF NAGA BY AMENDING SECTION 3 (a) OF ARTICLE II, FIRST PARAGRAPH OF ARTICLE VII, SECTIONS 27 AND 28 OF ARTICLE IX AND SECTIONS 31 AND 32 OF ARTICLE X OF ORDINANCE NO. 98-033, OTHERWISE KNOWN AS THE KAANTABAY SA KAUSWAGAN ORDINANCE OF 1997, AND PROVIDING ADDITIONAL MEASURES TO ACHIEVE THE PURPOSES AND OBJECTIVES OF THE KAANTABAY SA KAUSWAGAN PROGRAM”, BY PROVIDING ANOTHER YEAR IN THE PERIOD OF AVAILMENT OF THE ONE-TIME ACROSS-THE-BOARD CONDONATION OF PENALTIES AND SURCHARGES, SUBJECT TO CERTAIN CONDITIONS.”, BY PROVIDING ANOTHER TWO (2) YEARS IN THE PERIOD OF AVAILMENT OF THE ONE-TIME ACROSS-THE-BOARD CONDONATION OF PENALTIES AND SURCHARGES, SUBJECT TO CERTAIN CONDITIONS:-

On February 6, 2018, the 13th Sangguniang Panlungsod approved Ordinance No. 2018-007 granting One-Time Across-The-Board Condonation of Penalties and Surcharges for the purpose of giving all the beneficiaries of the Kaantabay sa Kauswagan Program the opportunity to update their payments for the amortizations due on lots or house and lots awarded to them under the program, for a period of one year from the effectivity of such ordinance (Section 9 particularly).

However, due to insufficient time to disseminate the information regarding the said ordinance, very few were able to avail of the condonation at that time. Hence, Ordinance No. 2019-013 was approved on February 12, 2019, adding another year to the period of availing of the one-time, across-the-board condonation of penalties and surcharges.

Notably, during the past months, requests from the beneficiaries of the Kaantabay sa Kauswagan (KsK) Program for across-the-board condonation of penalties and surcharges in their respective lot payments have reached the Sangguaniang Panlungsod for appropriate consideration. In fact, even the City Mayor has endorsed in February 2024, similar requests for the Sangguniang Panlungsod to consider the grant of condonation.

On several times during the barangay consultations held in June and July of this year, residents-beneficiaries of the KSK Program raised perennial requests to the City Officials to consider granting condonation.

Taking cognizant of the requests and pleas of our constituents, whom we vowed to serve, hence the need for this measure in order to provide the KsK Beneficiaries the opportunity to update the payments for all such amortizations in arrears including the interest charges.

BE IT ORDAINED by the 14th Sangguniang Panlungsod of Naga that:

SECTION 1. ADDITIONAL PERIOD OF AVAILMENT FOR CONDONATION OF PENALTIES AND SURCHARGES. Two additional years shall be allowed for the availment of the across-the-board condonation of penalties and surcharges as provided under Section 1 of Ordinance No. 2019-013 to give the beneficiaries ample time to avail the condonation.

SECTION 2. MANNER OF AVAILMENT PERIOD. The condonation maybe availed by any delinquent beneficiary of the Kaantabay sa Kausawagan Program with the option of a one-time payment or installment of the total arrears within two years upon approval of this ordinance.

SECTION 3. WIDEST INFORMATION DISSEMINATION. The Housing and Settlements Development Office (HSDO) in collaboration with the Naga City Peoples Council (NCPC) and the Naga City Urban Poor Federation, Inc (NCUPFI) are hereby mandated to conduct a widest information dissemination of this ordinance to guarantee the target beneficiaries are properly informed thereof. The City Events Protocol & Public Information Office (CEPPIO) is hereby directed to post on the Naga City Government FB page and other social media platform on a quarterly basis to ensure widest dissemination.

SECTION 4. REPORTING. The Housing and Settlements Development Office (HSDO) is directed to submit a quarterly report to Sangguniang Panlungsod on the progress and updates of the compliance of this ordinance.

SECTION 5. EFFECTIVITY- This Ordinance shall take effect immediately upon its approval.
