ORDINANCE NO. 2022-106

AN ORDINANCE CREATING THE NAGA CITY SPORTS DEVELOPMENT COUNCIL, PROVIDING FOR ITS COMPOSITION, FUNCTIONS, AND APPROPRIATING FUNDS THEREFOR:-

EXPLANATORY NOTE

WHEREAS, Section 17, Article II of the 1987 Constitution states that “the State shall give priority to education, science and technology, arts, culture, and sports to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development”.

WHEREAS, Section 19 (1), Article XIV, of the 1987 Constitution provides that “The State shall promote physical education and encourage sports programs, league competitions, and amateur sports, including training for international competition, to foster self-discipline, teamwork and excellence for the development of a healthy and alert citizenry.”

WHEREAS, Section 2 of Republic Act No. 6847, also known as “The Philippine Sports Commission Act.”

WHEREAS, it shall be the policy of the City Government of Naga to promote an established and upgraded, comprehensive, competitive and dynamic sports program.

WHEREAS, To realize the goal of strengthening the sports program of the city, there is a need for the City Government to create the Naga City Sports Development Council, and provide for mechanisms thereof.

SECTION 1. Title. This Ordinance shall be known as the “Naga City Sports Development Council Ordinance.”

SECTION 2. Declaration of Policy. It shall be the policy of the City Government of Naga to promote the development and improvement of its sports programs through creating policies that will support and provide opportunities to adequate and advanced skills training to athletes, coaches, trainers, referees etc. from the grassroots level especially in the barangays.

SECTION 3. Definition of Terms. The following terms shall be defined for the purpose of this Ordinance:

A. Athletes– persons who train, participate, and compete in a particular sport or game.

B. Coaches– persons who are qualified to develop athletes’ potentials and skills, assist them in their training programs, monitor their training performance, and provide encouragement and motivation.

C. Managers– are assigned in overseeing the sports facility, game schedules, food service, and all the other resources needed for the team.

D. Trainers– persons who instruct and prepare an athlete mentally, technically, and strategically for a specific sport performance;

E. Referees– officials in a game who ensure that rules of the sport are being adhered to by the individuals or teams;

F. Event Coordinators/Officials– persons other than the referees who also help ensure the maintenance and standards of the game are being followed;

G. Sports– any form of competitive physical activity participated by individuals or teams against opposing individuals or teams.

H. Sports Programs– the devised plan and system of recruitment, training, tournaments and leagues.

SECTION 4. Creation of the Naga City Sports Development Council (NCSDC).

There is hereby established the Naga City Sports Development Council, led by the City Mayor, which shall act as the overall head of policy planning and development of all sports programs and activities of the City.

SECTION 5. Composition. It shall be headed by the City Mayor as the chairperson. The composition are as follows:

Chairperson: The City Mayor Co- Chairperson: Chairman, SP Committee on Youth and Sports Development Secretariat: Education, Sports, and Scholarship Office Members:

  1. Committee on Youth and Sports Development Sangguniang Panlungsod Members;

  2. Committee on Youth and Sports Development, City Youth Official Counterpart;

  3. Liga ng mga Barangay President;

  4. City Mayor’s Sports Coordinator;

  5. Local Government Unit Sports Coaches;

  6. Federated Presidents of Sports Club and Organizations in Naga City;

  7. Chairman, SP Committee on Persons with Disability;

  8. Representative, School Board

SECTION 6. Functions and Responsibilities. The Sports Development Council shall have following functions and responsibilities:

a. Shall formulate, develop, and recommend policies and programs that will

i. Institute training programs and avenues for every sport as well as set venues for all sports competitions held within the City: ii. Implement refresher training opportunities for sports managers, coaches, referees and other officiating officials to set and enhance their foundation and fine-tune their skills; iii. Encourage active participation in all sports activities from the barangays of the city, Government Organizations, Non- Government Organizations (NGOs); iv. Encourage potential athletes to participate in the city’s sports trainings and programs; v. Provide technical, logistical, and other support to the City’s athletes;

b. Shall espouse the city’s system of registration and accreditation to all qualified sports organizations and associations in the city;

c. Shall develop policies and guidelines for the supervision, management, maintenance, and utilization of all sports facilities in the City;

d. Shall exercise diligence in monitoring and evaluating the city’s sports plans and programs to ensure its advancement, dynamism and competitiveness and subsequently formulate and recommend measures to strengthen such;

e. Shall recommend programs and activities in line with the City’s sports development such as sports tournaments, leagues, events, trainings, and other related activities;

f. Shall ensure the inclusivity of marginalized sectors including but not limited to, individuals belonging to the LGBTQ community and persons with disabilities in the development of its policies and programs; and

g. Undertake such other functions provided by law.

SECTION 7. Meetings and Quorum. The Naga City Sports Development Council shall be convened and presided by the Chairperson quarterly or as often as may be deemed necessary. In the absence of the Chairperson, the Co-Chairperson will execute the said functions. In the event the Chairperson and Co-Chairperson are unable to preside, at least two-thirds of the membership may call for a meeting. A written notice, sent through digital or non-digital means setting the time, date, place, and agenda of the meeting shall be sent at least one (1) week before. At least half of the council membership plus one shall constitute a quorum.

SECTION 8. Funding. The City Government shall allocate funds for the meetings and other relevant expenses of the NCSDC, to be incorporated in the Education, Sports, and Scholarship Office’s (ESSO) Sports fund.

SECTION 9. Repealing Clause. All Ordinances, resolutions, orders, memoranda, and other issuances inconsistent with the provisions of this Ordinance are hereby amended, repealed, revoked or modified accordingly.

SECTION 10. Separability Clause. If for any reason a provision of this Ordinance is declared invalid or unconstitutional, all other provisions hereof not affected thereby shall continue to be in full force and effect.

SECTION 11. Effectivity Clause. This Ordinance shall take effect upon the approval of the Sangguniang Panlungsod.
