ORDINANCE NO. 2022-049

AN ORDINANCE CONSOLIDATING ALL AMENDMENTS TO AND INTO ORDINANCE NO. 2016-054, KNOWN AS THE 2022 REVISED CONSOLIDATED SENIOR CITIZENS ORDINANCES OF 2016:

Explanatory Note

After the enactment of R.A. 7432 known as “An Act to Maximize the Contribution of Senior Citizens to Nation Building, Grant Benefits and Special Privileges and for Other Purposes” at least four more related laws were adopted.

Immediately after the promulgation of the first senior citizens law, the City of Naga likewise legislated Ordinance No. 1992-042 creating the Office of the Senior Citizens Affair. Then followed several related or amendment ordinances, supplemented by a resolution and an executive order, to wit: No. 1992-049, An Ordinance Granting Discounted Fares to Senior Citizens in Common Carriers Operating in the City of Naga; No. 2002-017, An Ordinance Appropriating the Amount of One Hundred Thousand (P100,000) Pesos out of the Unappropriated Surplus for the Year 2001 to Cover the Death Assistance to Affiliated Senior Citizens of the City of Naga at One Thousand (P1,000) Pesos per Beneficiary; No. 2006-70, An Ordinance Creating the Office for the Senior Citizens Affairs (OSCA) Headed by a Senior Citizen in the City of Naga as Mandated by R.A 9257; No. 2008-091, An Ordinance Establishing a Cash Assistance for Death Expenses for Senior Citizens of the City of Naga; 2010-066, An Ordinance Mandating an Increased Budget Allocation for Senior Citizens and Persons with Disability (PWDS), Allocating No Less Than One Percent (1%) of City and Barangay Budgets for Each Sector, and Requiring Implementation Beginning Year 2011; No. 2011-018, An Ordinance Implementing Extra Privileges to Senior Citizens in Naga City; No. 2013-036, An Ordinance Establishing a Trust Fund for the Office for Senior Citizens Affair (OSCA) in the City of Naga; No. 2013-054, An Ordinance Prescribing the Replacement of Senior Citizens Lost/Worn-out and Mutilated ID’s and Purchase Booklets for Medicines and Prime Commodities and Prescribing Fees Thereof; and, No. 2014-034, An Ordinance Amending Section 2 or Ordinance No. 2008-091, Entitled: “An Ordinance Establishing a Cash Assistance for Death Expenses for Senior Citizens of the City of Naga” by Increasing the Cash Assistance from Two Thousand (P2,000) Pesos to Three Thousand (P3,000) Pesos.

On January 5, 2015, City Mayor John G. Bongat approved ordinance No. 2014-085 known as the Consolidated Senior Citizens Ordinance.

This current ordinance now incorporates all amendments to Ordinance No. 2016-054 adopted after 18 October 2016 to date.

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. Title. This ordinance shall be known as the “2022 Revised Consolidated Senior Citizens Ordinances”.

SECTION 2. Adoption of Policies and Objectives. The City of Naga hereby adopts the declared policies and objectives in Section 2 of R.A. 9994, otherwise known as “An Act Granting Additional Benefits and Privileges to Senior Citizens, Further Amending Republic Act No. 7432, as Amended, Otherwise Known as ‘An Act to Maximize the Contribution of Senior Citizens to Nation Building, Grant Benefits and Special Privileges and for Other Purposes “, more specifically:

a. To establish mechanisms whereby the contributions of the senior citizens may be maximized;
b. To adopt measures whereby our senior citizens are assisted and appreciated by the community as a whole;
c. To establish a program beneficial to senior citizens, their families, and the rest of the community they serve;
d. To establish community-based health and rehabilitation programs for senior citizens in every political unit of society.

SECTION 3. Additional Privileges and Responsibilities. In addition to the benefits and privileges enumerated in Section 4 of R.A. 9994, in Naga City:

a. All senior citizens registered with OSCA shall be entitled to the following benefits and privileges:

  1. Comfortable seats in public conveyances, e.g. buses, vans, jeepneys, tricycles;
  2. Priority in services in drug stores, restaurants, groceries, markets, etc.;
  3. Free movie once a week at the designated theater and at the designated date and time;
  4. Additional financial assistance of One Thousand Pesos (P1,000.00) to the family for the death of the affiliated senior citizen.

b. In this regard, the management of establishments shall assume the following responsibilities:

  1. Where customers must queue for service, as in fast food centers or payment counters, to provide marked lanes that shall give priority to senior citizens;
  2. In restaurants and on buses, to reserve seats most convenient for entrance and exit or for embarking and disembarking;
  3. In dealing with senior citizens, to extend the utmost patience and due respect.

SECTION 4. Senior Citizens Planning Assembly. Within the first month of the beginning of a new City administration, the Chair of the Sangguniang Panlungsod Committee on Senior Citizens shall conduct a planning workshop covering the next three years and submit its plan for approval by the Senior Citizens Stakeholders Assembly.

a. The workshop output shall include: (a) the three-year general objectives, (b) three-year specific objectives with their corresponding strategies/activities and budgetary requirements, (c) provisions for evaluation.

b. The planning workshop shall involve: (a) the Chair and the members of the SP Committee on Senior Citizens; (b) the Department Head and one (1) staff member of the CSWDO; (c) the Head and one (1) staff member of the OSCA; (d) the President and two (2) other officers of the NCSCFI.

c. The Senior Citizens Stakeholders Assembly shall be composed of the Chair of the SP Committee on Senior Citizens as Convenor and Chair, and as members: (a) all the members of the planning workshop (b) all 27 BASCA Presidents; (c) one member (non-officer!) from each of the 27 BASCAS; (d) the Chairman and two (2) other officers of the Naga City People’s Council (NCPC); (e) the President and two (2) other officers of the Liga ng mga Barangay; (f) the Chair and two (2) other officers of the Naga City Council for Women (NCCW).

d. The Chair, CSWDO Department Head, the OSCA Head, the NCSCFI President and a designated NCPC representative shall consolidate the three-year plans and recommendations approved by the Senior Citizens Stakeholders Assembly for inclusion in the Executive-Legislative Agenda (ELA) and eventual approval by the SP and the City Mayor.

SECTION 5. Senior Citizens Coordinating and Monitoring Board. As suggested by Rule VIII, Section 5 of the Implementing Rules and Regulations (IRR) of R.A. 9994, there shall be a mechanism on the implementation of R.A. 9994 to be known as the Senior Citizens Coordinating and Monitoring Board (SCCMB).

a. The SCCMB shall be composed of: the Social Welfare and Development Officer as Chairman, and as members: the Head of the OSCA, the NCSCFI President, the designated NCPC representative, and the Chair of the SP Committee on Senior Citizens. Whenever necessary, the SCCMB shall call for the participation of the City Legal Officer, the City Health Officer, the Department of Trade and Industry (DTI) Field Officer, and such other officers or representative of related offices and agencies.

b. The SCCMB shall have the following duties and functions:

  1. To monitor the efficient and uniform implementation of RA 9994 and other issuances and ordinances on senior citizens;
  2. To recommend effective and innovative approaches and methods to address merging concerns of the senior citizens;
  3. To monitor the timely implementation of the 3-year senior citizens plan;
  4. To assist the Barangay Association of Senior Citizens Affairs (BASCA) in their synchronized elections;
  5. To conduct the election of the City Senior Citizens Officials Program;

c. In the performance of its functions, the SCCMB shall meet at least quarterly and also to resolve issues for complaints and other concerns, if any, related to senior citizens affairs.

d. The SCCMB shall use part of the special purpose appropriation for the senior citizens budgeted for operation and implementation of its functions.

e. The OSCA shall serve as the SCCMB secretariat.

SECTION 6. Office of the Senior Citizens Affairs. Pursuant to Section 6 of R.A. 9994, there shall be the Office of the Senior Citizen Affairs (OSCA).

a. The head of the OSCA shall be a senior citizen chosen from a list of three (3) nominees of the general assembly of the accredited senior citizens association of Naga City. He shall be selected and appointed by the City Mayor for a single term of three (3) years without prejudice to an extension if exigency so requires. During his term, he may not be removed except for reason of death, permanent disability or ineffective performance of his duties to the detriment of fellow senior citizens.

b. The senior citizen to be appointed by the City Mayor as OSCA Head should have the following qualifications:

  1. A Filipino citizen and resident of the city for at least one (1) year;
  2. A registered voter of Naga City;
  3. Able to read and write;
  4. Must be physically and mentally capable of performing the tasks of the OSCA Head;
  5. A bona fide member of a duly registered senior citizens organization.
  6. Good moral character; and
  7. At least high school graduate

c. The OSCA shall serve the interest of the senior citizens and shall function:

  1. To prepare the working draft of the 3-year senior citizens plan for the planning workshop;
  2. To act as the lead and main implementor of the 3-year senior citizens plan;
  3. To draw up a list of available and required services which can be provided by senior citizens, upon consultation with the senior citizen federation;
  4. To maintain and regularly update on a quarterly basis the Senior Citizens Master List and to issue, free of charge for the first instance, the Senior Citizen Official Identification Card (ID) and Purchase Booklet which shall be valid anywhere in the country but shall be distinguishably for Naga City senior citizens;
  5. To serve as a general information and liaison center to serve the needs of the senior citizens;
  6. To monitor compliance of the provisions of this ordinance and other national laws, particularly the grant of special discount and privileges to senior citizens;
  7. To report to the City Mayor individuals, but especially establishments found violating any provision of this ordinance and applicable national laws; and
  8. To assist the Senior Citizens in filing complaints or charges against any establishment, institution, or any agency refusing to comply with the privileges under R.A. No. 9257 before the Department of Justice or the city or regional trial court.

d. All salaries and wages of items created under this ordinance as well as maintenance and other operating expenses shall have their own budgetary allocation in the annual Local Expenditure Program.

e. No less than one percent (1%) each of the city and of the barangay annual budgets shall be allocated for benefits, plans, programs, and activities of the senior citizens either organized, implemented, and/or sanctioned by the OSCA and/or by other General Administrative, Social, Economic Services departments/offices of Naga City or, in the barangay level, by the BASCA and/or by the Senior Citizens Committee of the Barangay Council.

f. All fund disbursements for various plans, programs, and activities for the benefit of the senior citizens shall be based on a Work and Financial Plan duly endorsed by the Sangguniang Barangay or the OSCA and duly approved by the Punong Barangay, or by the City Mayor, as the case may be.

g. Twenty-Five Pesos (P25.00) shall be charged for replacement of lost or filled-up Purchase Booklet payable at the Treasurer’s Office.

SECTION 7. Senior Citizens Associations. Even as City Hall officials and offices respond to individual needs of senior citizens, the OSCA shall coordinate and assist in organized efforts by organized senior citizens associations.

a. Barangay Association of Senior Citizens Affairs (BASCA)

  1. There shall be one (1) Barangay Association of Senior Citizens Affairs (BASCA) in each of the twenty-seven (27) barangays of Naga City and shall hold office in their respective barangay halls.

  2. By January 31 of each year, each BASCA shall submit to the OSCA a certified report of: (a) an official list of all the senior citizens of the barangay, indicating relevant information as to date of birth, age, address, and payment of Annual Dues for the preceding year.

  3. OSCA, in preparation of its budget for the incoming year, shall include under AID to BASCAs appropriation equivalent to the amount paid by BASCA members for their Membership Dues for the preceding year and are still living as of June 30 of the current year.

  4. Naga City LGU shall provide one hundred pesos (P100.00) counterpart AID to the BASCA for every senior citizen registered with the OSCA who paid their BASCA Membership Dues for the preceding year and are still living as of June 30 of the current year; provided, that the LGU counterpart shall be spent solely for direct and exclusive benefits of majority of BASCA members.

  5. Thus, when the BASCA submits its Work and Financial Plan (WFP) for inclusion in the Barangay Budget, it should include in three (3) columns as sources of its appropriations: (1) Barangay – 1% of the total barangay Budget, (2) Annual Dues Collected the previous year, (3) LGU Counterpart.

  6. The funds sourced from the barangay shall be appropriated and disbursed by the barangay subject to barangay accounting and auditing rules. The funds sourced from the Naga City LGU shall be appropriated under the Special Program Appropriation-Senior Citizens and shall be disbursed by the OSCA subject to accounting and auditing rules. The funds sourced from the Annual Dues collected shall be appropriated and disbursed by the BASCA subject to accounting and auditing rules.

  7. Each BASCA shall submit to the OSCA its previous year’s annual financial report by 31 January for the BASCA to be entitled to the LGU counterpart for the next year.

  8. Any expenditure in support of maintenance or activities of the federation of BASCAS may be charged only to the Annual Dues.

b. Naga City Senior Citizens Federation, Inc. (NCSCFI)

  1. The Naga City Senior Citizens Federation, Inc. (NCSCFI) shall be recognized as the official umbrella organization of all the BASCAs in the city.

  2. Each BASCA shall submit to its respective Punong Barangay its annual plans and requests for budgetary assistance from the barangay.

  3. The NCSCFI shall collate its own as well as all BASCA annual plans and requests for budgetary assistance from the City Government and submit the same to OSCA for consideration and accommodation in time for the annual budgeting process of the City Government beginning in August each year.

SECTION 8. Senior Citizens Month. Even as the National Senior Citizens’ Day is celebrated on September 8 each year, the Senior Citizens Month shall be observed in October.

SECTION 9. City Senior Citizen Officials Program. In observance of the Senior Citizens Month, the City Senior Citizen Officials Program is adopted as revised whereby one senior citizen from each of the 27 barangays shall sit as city official or department head counterpart in October each year.

a. Composition and Manner of Election

  1. There shall be one senior citizen counterpart for the City Mayor, one for the City Vice-Mayor, twelve counterparts for the City Councilors, one counterpart for the Sanggunian Secretary, and twelve counterparts for department heads or heads of offices.
  2. The SCCMB shall set the period and guidelines for and shall supervise the election of the City Senior Citizen Officials.
  3. Each Barangay Association of Senior Citizens Affairs (BASCA) shall submit to the Chair of SCCMB its single member-nominee’s Resolution of Nomination and Certificate of Candidacy. Provided that beginning 2016, all senior citizens who have served as City Senior Citizen Official only once from the inception of this program in 2006 to 2015 shall be qualified for nomination by their respective BASCA and may be elected by the NCSCFI Board for the last time. Thereafter, any senior citizen who has served for two terms, whether consecutive or not, may no longer be nominated and elected.
  4. The Presidents of the twenty-seven Barangay Association of Senior Citizens Affairs shall from the BASCA nominees elect through secret balloting the full complement of fourteen (14) city officials’ counterparts.
  5. The candidate with the highest number of votes shall be the City Senior Citizen Mayor; the second highest, the City Senior Citizen Vice-Mayor; and, the next twelve, the twelve City Senior Citizen Councilors.
  6. The Senior Citizen Mayor-elect shall designate the remaining BASCA nominees as counterparts for the Sanggunian Secretary and for department heads or heads of offices.

b. Term of Office, Functions, and Honorarium

  1. The term of the City Senior Citizen Officials shall be from October 1 to 30 each year.
  2. They shall serve as counterpart of the elected or appointed officials and shall perform similar duties and functions of their counterparts, except matters pertaining to monetary disbursement.
  3. Each City Senior Citizen Councilor shall automatically become the Chairman, Co-chairman, or Member of the Sangguniang Panlungsod Standing Committee in which the regular City Councilor of whom the former is the counterpart is the Chairman, Co-chairman, or Member.
  4. During the joint session with the regular Sangguniang Panlungsod, the CSCOS shall participate in the deliberations but shall have no voting power.
  5. Aside from the joint session, the CSCOs shall schedule a separate day for their regular session to deliberate on matters for proposal to the Sanggunian.
  6. At the end of their term, the Senior Citizen City Mayor shall convene all the elected and appointed CSCOs for an evaluation of their CSCOP and submit the evaluation report to the City Mayor, the Sangguniang Panlungsod, and the OSCA.
  7. All CSCOs shall receive honorarium on a daily wage basis.

SECTION 10. Best Performing BASCA. The Best Performing BASCA Award is instituted to prime senior citizen activity and to recognize outstanding performance among the barangay associations.

a) Criteria for Selection. The following shall be the general criteria for the selection of the awardees:

  • Financial Management:                                     20%
  • Office Procedures/Record-Keeping:               10%
  • Programs/Projects/Activities Implemented catering to the needs of the members:           50%
  • Participation in City/Barangay Activities:    20% TOTAL:                                                                100%

b) Rewards. The top three BASCAS with the overall highest ratings shall be given the following rewards:

  • First Place: A plaque, and Five Hundred Thousand Pesos (P500,000.00).
  • Second Place: A plaque, and Three Hundred Thousand Pesos (P300,000.00).
  • Third Place: A plaque, and Two Hundred Thousand Pesos (P200,000.00).
  • Qualifiers: A Certificate and Fifty Thousand Pesos (P50,000) to all BASCAs rated 75% or higher.

The BASCA-awardees may apportion their rewards as: at most fifty percent (50%) for maintenance and other operating expenses and/or capital expenditure and at least fifty percent (50%) for livelihood projects. Provided that the written plan for utilization of the reward is acknowledged by the Barangay Council. Furthermore, the utilization of the reward shall be subject to applicable accounting and auditing rules and regulations.

c) Funding. The funding requirement for the implementation of award shall be incorporated in the annual Special Purpose Appropriation for Senior Citizens.

d) Composition of Best Performing BASCA Award Committee. The Best Performing BASCA Award Committee is hereby constituted and shall be composed of the Heads, or designated representatives, of the following:

Chairman – Permanent Designate, SP Committee on Senior Citizens
Members – Permanent Designate Office of the Senior Citizens Affairs (OSCA)
– Permanent Designate City Social Welfare and Development (CSWD)
– Permanent Designate Naga City People’s Council (NCPC)
– Permanent Designate Liga ng Mga Barangay (LIGA)

e) Selection Period. The selection and evaluation period shall begin in October and shall end in August each year.

f) Awarding and Presentation of the Best Performing BASCA Awardees. Awarding and Presentation of the Best Performing BASCA Awardees shall be on September 8 of every year. The event shall be one of the highlights of the Senior Citizens Anniversary.”

SECTION 11. Prescription of New Senior Citizens Identification Card. Two new senior citizens identification cards (ID) are hereby prescribed.

a. The first new ID shall conform to these specifications:

  1. It shall be of special paper material measuring about eight by five centimeters, plastic laminated.
  2. Its four corners shall be angular.
  3. The front shall be bordered with multi-color (subject to the approval of the chief executive).
  4. The front shall be landscape oriented and bear (1) the heading “Republic of the Philippines/ City Government of Naga/ Office for Senior Citizens Affairs (2) the senior citizen’s photograph (3) his/her full name first, middle initial, family; (4) his/her ID number; (5) his/her signature and thumb mark (when possible); (6) the official seal of the City of Naga.
  5. The back shall be landscape oriented and shall bear (a) the senior citizen’s Naga City address, date of birth, gender; (b) names of 2 persons to notify in case of emergency, together with their addresses and contact numbers; (c) name and signature of the City Mayor and OSCA Head.
  6. The front shall indicate the non-transferability of the ID as well as its validity for use nationwide. The back shall warn on penalties for violation of RA’s 9257 and 9994.

b. The second new ID shall conform to these specifications:

  1. It shall be a polyvinyl chlorine material (PVC) measuring about eight by five centimeters.
  2. The four corners shall be rounded.
  3. The front shall be multi-colored background (subject to the approval of the incumbent chief executive).
  4. The front shall be landscape oriented and bear: (1) the heading “Republic of the Philippines/ City Government of Naga/ Office For Senior Affairs; (2) the senior citizen’s photograph; (3) his/her full name – first, middle initial, family; (4) his/her ID number and bar code; (5) his/her signature and thumb mark (when possible); (6) the official seal of the City of Naga.
  5. The back shall be landscape oriented and shall bear (a) the senior citizen’s Naga City Address, date of birth, gender; (b) names of two persons to notify in case of emergency, together with their addresses and contact numbers; (c) name and signature of the City Mayor and of the OSCA Head.
  6. The front shall indicate the non-transferability of the ID as well as its validity for use nationwide. The back shall warn on penalties for violation of RA’s 9257 and 9994.

c. Invalidation of Old Identification Cards. All Naga City old, plain white senior citizens ID cards issued before 1 July 2016 shall be deemed invalid in Naga City beginning 1 January 2017.

d. Free Replacement of Old ID Cards. All Naga City senior citizen old, plain white ID cards shall be replaced free of charge with the appropriate ID that the senior citizen qualified for.

e. Requirements for New Entrants. All senior citizens applying for registration for the first time and for issuance of the new senior citizen’s ID free of charge shall submit the following:

  1. Duly accomplished application form
  2. Birth certificate, or any public document indicating the applicant’s Filipino and senior citizenship
  3. Barangay Certificate of Residency for at least six months or two (2) proofs of billing or receipts of Naga City real estate tax payment prior to the application for registration
  4. Photocopy of Naga City Voter’s ID or COMELEC Certificate of Registration or COMELEC Certification of Cancellation of Registration

f. The special paper ID shall be issued to senior citizens without item e4 above.

g. Requirements for Replacement of Old ID Cards. All senior citizens applying for replacement of their old, plain white IDs with the new ones shall surrender their old IDs and submit the same items listed in Sub-section e. The same requirements shall be required of all senior citizens who have transferred residence from elsewhere to Naga City.

h. Requirements for Replacement of Lost ID Cards. All senior citizens applying for replacement of their lost old or new IDs with the new ones shall submit the same items listed in Sub-section e together with an affidavit of loss. One hundred pesos (P100.00) shall be charged for the replacement.

i. Personal Verification. For all senior citizens either applying for first time registration or for replacement of old or lost IDs shall do so personally at the OSCA center or at designated times and places in their respective barangays so that their photographs may be taken. CSWDO Barangay Workers shall assist the registration and/or replacement of IDs and take the photographs of senior citizens who for reason of infirmity can no longer go to the OSCA or at the designated time and place in their barangays.

j. Benefits Exclusive to Naga City OSCA PVC ID Bearers. Even as presentation of any proof of senior citizenship entitles the bearer to the benefits and privileges enumerated in RA 9994 and issuances of various government agencies, effective 1 January 2017 only Naga City new OSCA PVC ID bearers shall be entitled to free movies at SM City and such other designated cinemas, as well as the additional one thousand pesos (P1,000.00) burial benefits, and such other benefits that Naga City may later grant over and beyond those provided in RA 9994.

k. Wait Time. The new IDs shall be available upon registration at the OSCA or at most fifteen working days from the time the application for first time registration or for replacement is filed at the OSCA or at designated centers in the barangay.

SECTION 12. Indigent and Abandoned Senior Citizens. The City Government shall extend preferential care for indigent and abandoned senior citizens.

a. The City Social Welfare and Development Office and the Office for Senior Citizens Affairs shall undertake the annual identification, classification and registration of indigent and abandoned senior citizen-OSCA ID holders.

b. The City Government shall aim at the establishment of a community for the indigent, abandoned senior citizens of the city. Meanwhile, it shall subsidize the accommodation of and care for indigent, abandoned senior citizens in existing private homes and institutions for the aged within Naga City. Provided that:

  1. The number of indigent, abandoned senior citizens whose accommodation and care shall be subsidized by the City Government shall depend upon the available slots in the private homes and institutions for the aged accredited by the City Government.
  2. Priority shall be given to senior citizens: (a) who are without pension or permanent source of income, compensation, or regular and appropriate financial assistance from relatives/benefactors to support basic needs; (b) who do not own a house; (c) who live alone and whose closest relative lives outside Naga City; (d) who expresses willingness to live in a home/institution for the aged.

c. The City Government shall distribute ten (10) kilos of rice each month to the most indigent abandoned senior citizens: (a) who qualified for b2 above but could not yet be accommodated due to b1 above; (b) who meet the requirements b2a and b2b above and who alone must support/care for person(s) other than themselves.

d. The City Government shall distribute grocery packages to all other indigent senior citizens in time for Peñafrancia Fiesta and Christmas.

SECTION 13. City Centenarians Incentive Ordinance.

a. Cash Incentive and Recognition. – One hundred thousand pesos (P100,000.00) shall be given by the City of Naga as a one-time incentive to each qualified person on the occasion of his/her 100th birthday. A plaque of recognition shall be awarded to him/her or to his/her nearest surviving relative in an appropriate ceremony on the National Respect for Centenarians Day in October. Both the cash incentive and the plaque of recognition shall likewise be given to each living resident who turned one hundred years old prior to the enactment of RA 10868 on June 23, 2016 and of this Ordinance. The cash incentive and the plaque of recognition shall be given to the nearest surviving relative of one who turned one hundred years old prior to the enactment of RA 10868 and of this Ordinance but who unfortunately died before the incentive and the plaque could be given.

b. Documentary Requirements. – Before September 1 prior to the forthcoming Respect for Centenarians Day at which the centenarian is proposed to be given the cash incentive, s/he or her/his authorized representative shall submit to the City Social Welfare Development any government-issued identification card or document that establishes the centenarian’s: (a) Filipino citizenship, (b) one-hundred-year-old age, and (c) Naga City residency over at least the last ten (10) years. The primary and secondary documents listed in Rule VI in the Implementing Rules and Regulations of Republic Act No. 10868 shall suffice in lieu of the aforementioned requirements. Toward this end, the Head of the Office for Senior Citizens Affairs shall identify prospective centenarians and assist them and their families in the preparation and submission of the documentary requirements.

c. Funding. – The cash incentives shall be provided in the annual budget under the Special Purpose Appropriation-Senior Citizens.

SECTION 14. Care for Indigent Near-Centenarians.

a. Beginning January 2020, after their ninety-sixth (96th) birthday, all qualified senior citizens registered in the OSCA shall be provided with monthly health food supplement worth one thousand pesos (P1.000.00) until their death or their one hundredth (100th) birthday, whichever comes first.

b. To qualify, the senior citizen must be: (a) registered with and OSCA ID holder for at least the last five (5) years; (b) at least ninety-six (96) years old;

c. Barangay Social Workers shall deliver the health food supplement within the first week of each month; shall cause the delivery to be received by the beneficiary or by officially designated recipients; and shall submit monitoring report to both the OSCA and the CSWD.

d. Once the implementation of this section begins, OSCA shall secure from all current near centenarians aged 96 to 99 written manifestations whether or not they shall partake of the benefits provided in this section or prefer the full P100,000.00 incentive on their 100th birthday as provided earlier by Ordinance 2016-054.

e. Toward this end, the Head of OSCA shall identify prospective beneficiaries and assist them and their families in the preparation and submission of the documentary requirements.

SECTION 15. Cash Incentive and Recognition for Centenarians.

a. Supplementary to the One Hundred Thousand Pesos (P100.000.00) Centenarian Gift from the National Government as provided by Republic Act 10868, the City of Naga LGU shall grant One Hundred Thousand Pesos (P100.000.00) as one-time incentive to each qualified person on the occasion of his/her 100th birthday. A plaque of recognition shall be awarded to him/her or to his/her nearest surviving relative in an appropriate ceremony on the National Respect for Centenarians Day in October.

b. Provided, however, that centenarians who began partaking of the monthly food supplement, as provided in Section 14 above, already on their 96th year shall be granted Sixty-Thousand Pesos ((P60.000.00): those on their 97th year shall be granted Seventy Thousand Pesos (P70.000.00); those on their 98th, Eighty Thousand Pesos (P80.000.00): those on their 99th, Ninety Thousand Pesos (P90.000.00), in lieu of the One Hundred Thousand Pesos (P100.000.00).

c. Documentary Requirements. SECTION 16. OSCA Trust Fund.

a. The OSCA Trust Fund is created and maintained at the Treasurer’s Office to provide additional financial and/or material aid to senior citizens for health care and rehabilitation system for the disabled senior citizens and extend assistance to the needs of the underprivileged, sick, and incapacitated elderly and give full support to the improvement of the well-being of the elderly.

b. To this OSCA Trust Fund shall be paid/deposited all payments for replacement of ID’s and Purchase Booklets, donations from individuals or institutions, earnings from income-generating activities and projects undertaken by the OSCA, and savings from externally-funded activities.

c. This OSCA Trust Fund shall be managed by Trustees that by resolution shall approve disbursements for full and exclusive assistance to senior citizens in need and shall require annual audit of the same. The Trustees shall include:

  1. ) City Mayor – Chairman
  2. ) OSCA Head – Vice-Chairman
  3. ) Sangguniang Panlungsod Chairman of the Committee on Senior Citizens – Member
  4. ) City Treasurer – Member
  5. ) NCSCFI President – Member

SECTION 17. Penalties and Other Sanctions

a. The following acts concerning drug and medicine purchases are considered violations of the ordinance:

  1. A Senior Citizen or his/her representative or a person misusing the privileges by:
    a) using several purchase booklets;
    b) availing of the discount to buy medicines, drugs, medical accessories and supplies not for the use of the senior citizen;
    c) unauthorized use of the identification card of the senior citizen.

  2. A medical practitioner giving prescription to other persons in the name of the senior citizen or giving anomalous prescription.

  3. Retailers and establishments dispensing medicines:
    a) refusing to grant the full 20% senior citizens discount and VAT exemption on drug and medicine purchases paid via credit card;
    b) making a distinction between branded and generic drugs and medicines in giving the 20% discount;
    c) posting notices and signages telling customers that availment of the 20% discount is limited to cash purchases only;
    d) “limiting” of discountable drug and medicine purchases to certain weekdays only, such that senior citizens cannot avail of the 20% discount on other days, and e) restricting the purchase time or period for senior citizens to a particular hour each day only, i.e. refusing to grant senior citizen discounts after a certain hour.

  4. The following acts concerning food purchases are considered violations of the provisions of the ordinance:
    1. ) Pegging a maximum amount of food purchase subject to 20% discount and the VAT exemption, and/or posting of notice to that effect;
    2.) Refusal to grant the 20% discount and VAT exemption on take-out / take-home / drive-thru orders it appearing that the purchase is for the exclusive use and enjoyment of senior citizens;
    3.) Refusal to grant a discount for credit card payments; and
    4.) Refusal to grant a 20% discount and VAT exemption on delivery orders it appearing that the purchase is for the exclusive use and enjoyment of senior citizens.
    5.) Any person who refuses to honor the senior citizen card or violates any provision of the ordinance shall suffer the following penalties: One Thousand Pesos (P1,000.00) for the First Offense, Three Thousand Pesos (P3,000.00) for the Second Offense, and Five Thousand Pesos (P5,000.00) for the Third Offense and every succeeding offense thereafter.
    6.) If the offender is a corporation, partnership, organization or any similar entity, the officials thereof directly involved such as the president, general manager, managing partner, or such other officer charged with the management of the business affairs shall be liable.
    7.) Provided, however, that any person/establishment charged with violation of any of the provisions of this ordinance and does not wish to contest the charge (s) and is willing to pay the fine voluntarily prior to the filing of charges before the proper Court shall be allowed to pay the corresponding fine at the City Treasurer’s Office to avoid criminal prosecution within twelve (12) hours from apprehension; otherwise, the case shall be prosecuted.
    8.) Upon filing of an appropriate complaint, and after due notice and hearing, the proper authorities may also cause the cancellation or revocation of the business permit, permit to operate, franchise and other similar privileges granted to any person, establishment or business entity that fails to abide by the provisions of the Act, the Implementing Rules, and/or this ordinance.

SECTION 18. Separability Clause. Any provision of this ordinance found to be in violation of the Constitution or declared invalid by a competent court shall not impair the other provisions or parts thereof and shall continue to be in force and in effect.

SECTION 19. Repealing Clause. Ordinances, rules and regulations or parts thereof which are inconsistent or in conflict with provisions of this ordinance are hereby repealed. Likewise, all previous senior citizen ordinances particularly, except for the persons with disabilities (PWD) provisions in Ordinance No. 2010-066, are hereby repealed.

SECTION 20. Effectivity. This ordinance shall become effective fifteen days after approval.
