ORDINANCE NO. 2022-003
AN ORDINANCE AUTHORIZING THE CLOSING OF CERTAIN ROADS AND THE USE THEREOF FOR CERTAIN PURPOSES, AND DEFINING PROHIBITED ACTS, AND PROVIDING PENALTIES FOR VIOLATIONS TO FACILITATE THE ORDERLY CONDUCT OF THE 2022 BAR EXAMINATIONS AT THE UNIVERSITY OF NUEVA CACERES, NAGA CITY ON JANUARY 23 AND 25, 2022:-

EXPLANATORY NOTES
Due to the Covid 19 pandemic, the Supreme Court of the Philippines decided to decentralize the conduct of Bar Exams for 2021.
Naga City has been chosen as one of the testing centers every Sunday starting January 16 to February 6, 2022.
Considering the importance of this event, there is a need to conduct comprehensive preparations including re-routing of vehicles, designation of appropriate parking spaces, among others.
Hence, this Ordinance.
Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:
SECTION 1- DESIGNATION OF STREETS TO BE CLOSED
The following streets are to be closed, the time of closure and subsequent opening shall be determined by the Incident Management Team (IMT) created for the purpose and shall form part of this Ordinance:
(a) E. ANGELES COR ARANA ST. (MCDO)
(b) E. ANGELES COR P. BURGOS (JOLIBBEE)
(c) E. ANGELES KINASTILYUHAN (PLAZA Q & PLAZA RIZAL)
(d) E. ANGELES COR EVANGELISTA (3GX)
(e) GEN LUNA COR ABELLA EXT. (DUNKIN)
(f) J HERNANDEZ COR ABELLA (MASTER SQUARE)
(g) BAYAWAS ST COR URBAN QUEBORAC
(h) BARLIN ST COR P DIAZ (SADI BALOY)
(i) J HERNANDEZ COR P DIAZ
SECTION 2- DESIGNATION OF ONE WAY STREETS
The following are designated as one way streets:
(a) F. PLAZO COR COR ABELLA TO J. HERNANDEZ COR ABELLA
(b) BAYAWAS COR PARAISO TO STA CRUZ PORO COR BAYAWAS
(c) J HERNANDEZ COR ARANA TO STA CRUZ PORO COR BAYAWAS
SECTION 3- OTHER GUIDELINES
The IMT shall see to it that:
(a) Parking areas for the BAR examinees for consecutive Sundays starting January 16 will not include weekdays;
(b) Informative and directional signs shall be installed to guide motorist especially the BAR Examinees/Examiners, and the general public;
(c) Strict implementation of “NO PARKING” along critical roads and installation of “NO PARKING SIGNS”;
(d) Strict implementation of truck ban hours in the Central Business District especially along J. Hernandez Ave;
(e) Drop-off and pick-up points for the examinees shall be designated along Padre Burgos St. from corner Gen. Luna to corner J. Hernandez Ave. facing UNC left;
(f) To provide “CAR PASS” to be issued to the BAR examinees/examiners;
(g) To provide “CAR PASS” to be issued for the establishments (CBD 2).
SECTION 4- MECHANISMS BEFORE IMPLEMENTATION
The IMT created for this purpose shall endeavor to inform the general public and other stakeholders, particularly the barangays affected, business groups, among others, of the changes in traffic and parking to achieve peaceful and orderly conduct of the bar exams with very limited inconvenience to the general public.
SECTION 5- PROHIBITED ACTS- The prohibited acts contemplated in existing ordinances of the City are hereby adopted in this Ordinance. The fines however are subject to Section 9 hereof.
SECTION 6- SUSPENSION OF WHEEL CLAMP AND TOWING AT CBD 1- During the said period, the towing and wheel clamp ordinance of Naga City shall be temporarily suspended.
SECTION 7. INFORMATION AND ENFORCEMENT. The IMT and City Events Protocol and Public Information Office shall undertake the widest information dissemination of this Ordinance.
SECTION 8. The Office of the Mayor thru the IMT may, as appropriate, adjust traffic management to achieve the general purpose of this Ordinance, provided that the necessary adjustment is furnished the Sangguniang Panlungsod.
SECTION 9. PENALTIES. Any driver/private individual who refuses or fails to comply with the provisions of this ordinance shall suffer the following fines, based on the discretion of the Court:
(a) First offense a fine of One thousand pesos (P1,000.00);
(b) Second offense a fine of Two thousand pesos (P2,000.00);
(c) Third offense and subsequent offenses a fine of Three thousand pesos (P3,000.00) as determined by the Court.
SECTION 10. Separability Clause. Any provision or portion of this ordinance found to be in violation of the Constitution or invalid shall not impair the other provisions or parts thereof and shall remain in full force and effect.
SECTION 11. Repealing Clause. All existing ordinances, rules and regulations or parts thereof, which are inconsistent or in conflict with the provisions of this ordinance are hereby repealed, modified and/or supplemented accordingly.
SECTION 12. Effectivity. This ordinance shall take effect midnight of January 23 and 25, 2021, and after publication in a newspaper of local circulation.
