ORDINANCE NO. 2021-048

AN ORDINANCE FURTHER AMENDING SECTION 119, CHAPTER XVI OF ORDINANCE NO. 92-048, AS AMENDED BY ORDINANCE NOS. 98-109, OTHERWISE KNOWN AS THE “REVISED SANITARY CODE OF NAGA CITY”, BY INCREASING THE PENALTIES THEREOF:

EXPLANATORY NOTE

Some of the legal experts from the Sanitary Division under the City Health Office have forwarded comments and possible amendments to Ordinance No. 92-048, as amended by Ordinance No. 98-109, also known as the “Revised Sanitary Code of Naga City”, particularly Section 119, Chapter XVI thereof, to increase penalty for the purpose of reducing the commission of violations and strengthening the implementation of Chapter XIV of the Revised Sanitary Code of Naga City.

Be it ordained by the Sangguniang Panlungsod of Naga, in session assembled, that:

SECTION 1. – Section 119, Chapter XVI of Ordinance No. 92-048, as amended by Ordinance Nos. 98-109, otherwise known as the “Revised Sanitary Code of Naga City”, is hereby further amended by increasing the penalties thereof, now to read as follows:

“SECTION 119, Chapter XVI of Ordinance No. 92-048 is hereby amended, now to read as follows:

a. For violation of Section III person concerned shall be dealt with the following:

i. 1st Offense Reprimand
ii. 2nd Offense A fine of Three Thousand (P3,000) Pesos
iii. 3rd Offense A fine of Five Thousand (P5,000) pesos and imprisonment of six (6) months but not more than one (1) year upon the discretion of the court.

b. For violation of Sections 12, 13, 15, 16, 20, 36, 37, 38, 53, 81, 82, 83, 100, 101, 106 and 107, One Thousand (P1,000) Pesos or imprisonment of not exceeding one (1) month of both fine and imprisonment upon the discretion of the court.

c. For violation of Sections 5, 6, 7, 8, 9, 10, 11, 30, 39, 40, 41, 42, 56, 57, 58, 59, 60, 64, 66, 67, 69, 79, 85, 87, 88, 89, 90, 97, 99, 102, 103 and 109, shall be penalized with a fine of not less than One Thousand (P1,000.00) Pesos and an imprisonment of not less than one (1) month but not more than six (6) months or both upon the discretion of the court.

d. For violation of Section 89 and 104 the guilty person or party shall be penalized with a fine of not less than One Thousand (P1,000.00) Pesos or imprisonment of six (6) months but not more than two (2) years or both fine and imprisonment upon the discretion of the court.

e. For violation of Sections 70 & 71:

i. 1st Offense Reprimand
ii. 2nd Offense A fine of One Thousand (P1,000.00) Pesos
iii. 3rd Offense A fine of One Thousand Five Hundred (P1.500.00) Pesos and confiscation of pink card and license or imprisonment of one (1) month but not more than six (6) months or both upon the discretion of the court.

Any violation of any provision of this ordinance not covered by the preceding section shall be penalized as follows:

i. 1st Offense Reprimand
ii. 2nd Offense A fine of Five Hundred (P500.00) Pesos
iii. 3rd Offense Sanction of products, food and or goods being sold including their containers, and accessories and imprisonment of not more than one (1) month and or fine of more than One Thousand (P1,000.00) Pesos and confiscation and revocation of Sanitary Permit/License.”

SECTION 2. EFFECTIVITY. This ordinance shall take effect immediately upon its approval and after publication in a newspaper of local circulation.
