AN ORDINANCE EXERCISING THE POWER OF EMINENT DOMAIN OVER A PARCEL OF LAND, MEASURING TEN THOUSAND (10,000) HECTARES, MORE OR LESS, REGISTERED IN THE NAME OF MR. ANTONIO MERILLES, JR., LOCATED IN BARANGAY CAROLINA, NAGA CITY. TO BE UTILIZED AS SITE OF THE PROPOSED ELEMENTARY SCHOOL IN YABU, BARANGAY CAROLINA, NAGA CITY, APPROPRIATING THE AMOUNT OF FIVE HUNDRED FIFTY THOUSAND EIGHT HUNDRED EIGHTY EIGHT AND 35/100 PESOS (P550,888.35) TO COVER THE PAYMENT FOR JUST COMPENSATION, CHARGEABLE AGAINST THE ACCOUNT “DECENTRALIZED SERVICES SITES PROJECT” UNDER THE 2020 LOCAL DEVELOPMENT FUND, AND AUTHORIZING THE CITY MAYOR TO FILE THE NECESSARY EXPROPRIATION PROCEEDING IN COURT AND THE CITY LEGAL OFFICER TO APPEAR IN THE PRE-TRIAL THEREOF AND ENTER INTO COMPROMISE AGREEMENT THEREIN WITH THE CONCURRENCE OF THE SANGGUNIANG PANLUNGSOD

Summary: Ordinance No. 2020-087, enacted on September 15, 2020, authorizes the City Mayor to exercise the power of eminent domain to acquire a parcel of land measuring approximately ten thousand (10,000) hectares in Barangay Carolina, Naga City, registered under the name of Mr. Antonio Merilles Jr. This land is intended to be utilized as the site for the Decentralized Services Sites Project. The ordinance appropriates Five Hundred Fifty Thousand Eight Hundred Eighty Eight Pesos & 35/100 (P550,888.35) to cover the payment for just compensation, chargeable against the “Decentralized Services Sites Project” account under the 2020 Local Development Fund. The Mayor is empowered to initiate expropriation proceedings, represent the City Government in all stages, enter into compromises or amicable settlements (subject to Sangguniang Panlungsod concurrence), and perform other necessary acts to effect immediate possession of the properties.
