ORDINANCE NO. 2024-095
AN ORDINANCE AMENDING SECTIONS 1 (c) AND 1(i) OF ARTICLE VIII AND SECTION 3 (a) OF ARTICLE X OF ORDINANCE NO. 2000-071, TO ENHANCE THE CITY’S SPECIAL USE PERMIT REGULATIONS AND ZONING ENFORCEMENT MECHANISMS-

Be it ordained by the Sangguniang Panlungsod of Naga, that:
SECTION 1. Section 1(c) of Article VIII of City Ordinance No. 2000-071 is hereby amended, now to read as follows:
C. FILLING STATIONS
2. Filling stations shall be located at least fifty (50) meters away from the nearest schools, churches, hospitals and other similar buildings/institutions.
SECTION 2. Section 1(i) of Article VIII of City Ordinance No. 2000-071 is hereby amended, now to read as follows:
I. NIGHT CLUBS, CABARETS, BARS, VIDEOKES, PUB HOUSES, SAUNA BATHS, OR DISCOTHEQUES
1. No night clubs, cabaret, bars, video bars, pub houses, sauna baths or discotheques shall be established and maintained within a distance of fifty (50) meters from any public office, church, mosque, hospital, public or private school, seminary, missionary (charitable) houses, and other similar more institutions.”
Provided that, videoke bars, gigs, or those with live bands and similar establishments shall be fully sound proofed, and that Section 8 and 10, Article IV of Ordinance no. 2008-053, shall be strictly observed, as to music or sound emanating therefrom.
SECTION 3. Section 3 (a) of Article X of City Ordinance No. 2000-071 is also hereby amended, now to read as follows:
“A. PRE-REQUISITE FOR BUILDING AND BUSINESS PERMIT. No building permit shall be issued unless a Locational Clearance has been obtained from the City Zoning Administrator. Such locational clearance shall show among other things that the building or part thereof and the proposed uses of the same are in conformity with the provisions of this Ordinance. The City Zoning Administrator shall maintain a record of all Locational Clearances and a copy shall be furnished upon the request of any interested person.
Provided that, a site inspection of the exact location where the building is to be constructed, subject of the building permit being applied for, shall be conducted by the Building Official prior to the issuance of the building permit.
Provided finally, that, in the processing of new or renewal of business permit applications, no clearances from other agencies/offices of the city government shall be issued unless the city zoning administration division of the City Planning and Development Office (CPDO) approves the locational clearance of applicants.
SECTION 3. Effectivity. This ordinance shall take effect upon its approval and publication in newspapers of local circulation.
