AN ORDINANCE REGULATING THE LAND FILLING/BACK FILLING ACTIVITY IN THE CITY OF NAGA PROVIDING PENALTIES FOR VIOLATION THEREOF
Summary: Ordinance No. 2021-010, enacted on March 1, 2021, by the Sangguniang Panlungsod of Naga, establishes comprehensive regulations for land filling and backfilling activities within the city’s jurisdiction. The ordinance declares that such activities, while serving as initial site development, can negatively impact air quality and alter the natural landscape. It defines key terms, outlines strict prohibitions, and mandates specific requirements. These include obtaining a Certificate of Compliance from the City Environment and Natural Resources Office (ENRO) and, for larger developments (one hectare and above), an Environmental Compliance Certificate (ECC) from the DENR-EMB. The ordinance also prohibits dumping earth fill materials within the three-meter legal easement of natural waterways and requires soil erosion control measures. Vehicles transporting earth fill or quarry materials must be covered and possess necessary permits. The maximum level for land filling/backfilling activity is set at 1 meter high from the adjacent existing road. The ENRO is tasked with the administration and enforcement of this ordinance. Violations by property owners, developers, or contractors are subject to a fine of Five Thousand Pesos (P5,000.00) for the first offense, with similar fines for subsequent offenses.
