ORDINANCE NO. 2019-058

AN ORDINANCE AMENDING ORDINANCE NO. 2008-079, AS AMENDED, ENTITLED: “AN ORDINANCE PRESCRIBING GUIDELINES FOR PRELIMINARY APPROVAL FOR LOCATIONAL CLEARANCE (PALC), DEVELOPMENT PERMIT (DP) AND ALTERATION OF PLANS (AP) FOR RESIDENTIAL SUBDIVISION PROJECTS AND FOR OTHER PURPOSES IN THE CITY OF NAGA”, BY ADDING ARTICLE X THEREOF ON MONITORING FOR THE IMPLEMENTATION MECHANISM FOR SUBDIVISION PERMITS ISSUED BY THE NAGA CITY GOVERNMENT:-

Be it ordained by the Sangguniang Panlungsod of Naga, that:

SECTION 1. – Ordinance No. 2008-079, as amended, entitled: “An ordinance prescribing guidelines for Preliminary Approval for Locational Clearance (PALC), Development Permit (DP) and Alteration of Plans (AP) for Residential Subdivision Projects and for other purposes in the City of Naga”, is hereby amended by adding Article X thereof providing a monitoring mechanism for subdivision permits issued by the Naga City Government, now to read as follows:

“ARTICLE X

SECTION 25. Inter-agency Monitoring Team. (a) To ensure that the Development Permits (DP) issued under this ordinance are properly monitored, an inter-agency team chaired by the City Planning and Development Office (CPDO), with the City Engineer’s Office (CEO), City Environment and Natural Resources Office (ENRO), and Solid Waste management Office (SWMO) as members, is hereby created;

(b) The team shall conduct monitoring visits on a quarterly basis to all proposed subdivision projects granted a Development Permit (DP) and assess whether development being implemented are consistent with plans approved by the city government;

(c) A quarterly report shall be furnished the Office of the City Mayor and the Sangguniang Panlungsod for their information and guidance. Any deviation found shall serve as basis for the imposition of penalties as defined under Article XI of this ordinance.

SECTION 2. – The succeeding Articles thereof shall be marked as Article XI, and so on and so forth;

SECTION 3. This ordinance shall take effect upon its approval.
