PROPOSED LOCAL LEGISLATION

As expressed in Ordinance No. 2023-004 (i-Engage Ordinance), ordinary citizens have the power to help shape local laws. The following is a proposed measure, which can have a significant impact on the lives of fellow Nagueños. Your comments and suggestions can help improve this proposal.

Summary/Highlights

Title of Proposed Legislation:
AN ORDINANCE MANDATING BUSINESS ESTABLISHMENTS OPERATING WITHIN THE TERRITORIAL  JURISDICTION OF THE CITY OF NAGA TO INSTALL A CLOSED-CIRCUIT TELEVISION (CCTV) SYSTEM AND PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF

📹 CCTV Ordinance of Naga City

🧭 Purpose

To enhance public safety and crime prevention by mandating the installation of CCTV systems in specified business establishments and public service facilities within Naga City.

🏢 Scope of Coverage

CCTV installation is required for the following:

  • Financial institutions (banks, pawnshops, remittance centers)
  • National chain businesses (fast food, convenience stores, drugstores)
  • Government buildings (City Hall, Barangay Halls)
  • Hotels, apartelles, Airbnb accommodations
  • Malls, supermarkets, wet markets
  • Hospitals, clinics, laboratories
  • Restaurants, cafes
  • Subdivisions and housing settlements
  • Entertainment venues (cinemas, arcades, internet cafes)
  • Cultural events and concerts
  • Transport terminals, parking lots, car washes
  • Car dealerships, fuel stations, auto repair shops
  • Educational institutions and tutorial hubs
  • Establishments serving alcoholic beverages
  • Sports and fitness venues (gyms, pools, courts)
  • Cockpits
  • Businesses along national highways and major roads (excluding sari-sari stores and temporary vendors)
  • Other establishments as determined by the Technical Working Group (TWG), subject to public consultation

📷 Minimum Technical Specifications

  • At least 2MP HD cameras with infrared and wide dynamic range
  • Hybrid DVR system with 4+ camera inputs
  • 30 FPS recording, H.264 video compression
  • 40-day storage capacity minimum
  • Time stamping and centralized power with UPS
  • Minimum of 2 cameras per establishment, including street-facing coverage

🛠️ Installation Guidelines

  • Secure placement to avoid tampering and blind spots
  • Proper lighting and angle for facial and plate recognition
  • Backup systems and dummy cameras encouraged
  • Clear signage indicating CCTV monitoring
  • At least one trained staff member per establishment

🔐 Privacy Compliance

  • Must follow NPC Advisory No. 2024-02 and other privacy laws
  • Minimum 30-day retention of footage, extendable by court or city order

📌 Coverage Requirements

  • Interior: entrances/exits, transaction areas (cashiers, vaults)
  • Exterior: entrances/exits, street view, parking areas (if applicable)

🏛️ Implementing Office

  • Public Safety Office (PSO) oversees compliance and inspections
  • Certification from PSO is required for business permit issuance/renewal
  • PSO may consult with the local Chief of Police

📂 Access to Recordings

  • Establishments must provide recordings to police upon request or court order
  • Immediate reporting required if a crime is believed to be captured

🚫 Prohibitions

  • Viewing footage must respect individual privacy and dignity

⚖️ Penalties

  • No business permit issued/renewed without compliant CCTV
  • ₱5,000 fine per day of non-compliance

📤 Appeal Process

  • Violators may appeal to the Office of the Mayor within 5 working days
  • PSO must respond within 5 days; Mayor’s decision is final

📅 Compliance Timeline

  • Establishments have 45 days from ordinance effectivity to comply
