AN ORDINANCE STRENGTHENING THE IMPLEMENTATION OF CITY TRAFFIC CODES, REGULATIONS, AND OTHER ORDINANCES AS MAY BE IMPLEMENTED BY THE CITY GOVERNMENT OF NAGA; AMENDING ORDINANCE NO. 93-049; DESIGNATION OF OPEN-PUBLIC PARKINGS AND APPROPRIATING FUNDS THEREFOR

🚦 Purpose and Scope

  • Objective: Strengthen traffic and road regulations in Naga City to ensure safety, accessibility, and efficient vehicular movement.
  • Coverage: Applies to major public roads in Naga City; excludes alleyways and streets within subdivisions.

🛣️ Roads Covered

Includes 27 major roads such as:

  • Maharlika Highway
  • Almeda Highway
  • >Miranda Avenue
  • Peñafrancia Avenue
  • Magsaysay Avenue
  • Elias Angeles Street

🚫 Parking Regulations

  • Prohibited Areas:
    • All roads listed in Section 5
    • All sidewalks and pavements citywide
  • Allowed Parking:
    • On roads not listed in Section 5, provided vehicles do not cross the solid white shoulder line or obstruct traffic
  • Establishment Requirements:
    • Must provide on-site parking for customers and residents
    • New structures must maintain a 5-meter setback from roads (except barangay roads and alleyways)

🅿️ Public and Private Parking Spaces

  • City-Owned Lots: May be converted into 24/7 public parking areas
  • Privately-Owned Lots: Can be used for public parking via agreements with barangays or city government
  • Incentives: Private owners offering land for public use may receive local tax discounts

🚔 Enforcement and Penalties

  • Implementing Agency: Public Safety Office (PSO), in coordination with the PNP
  • Penalties:

1st Offense : ₱1,500 fine
2nd Offense: ₱2,500 fine
3rd Offense: 48-hour imprisonment

  • Apprehension Measures:
    • 1st: Wheel clamp + fine
    • 2nd: Towing + fine
    • 3rd: Detention + possible vehicle sequestration

📋 Reporting and Oversight

  • PSO must submit quarterly implementation reports to the City Mayor, Vice Mayor, and Sangguniang Panlungsod.

📜 Legal Provisions

  • Exemptions: Special permissions may be granted to commercial establishments with insufficient parking space.
  • Repealing Clause: Supersedes inconsistent ordinances, including Ordinance No. 93-049.
  • Effectivity: Upon approval and publication in a local newspaper.
