ORDINANCE NO. 2026-099

AN ORDINANCE AMENDING ORDINANCE NO. 2023-006, OTHERWISE KNOWN AS “AN ORDINANCE MANDATING THE REGISTRATION OF OWNERSHIP OF AGRICULTURAL AND FISHERIES MACHINERY AND EQUIPMENT IN NAGA CITY”

EXPLANATORY NOTE

In order to further empower the Agricultural and Biosystems Engineering Division (ABED) of the City Government of Naga, there is a need to officially transfer under its responsibility all functions falling under its mandate but previously assigned to the City Agriculture Office such as those for the registration of farm and fishery machineries as mandated under Ordinance No. 2023-006, otherwise known as “Mandatory Registration of Ownership of Agricultural and Fishery Machinery and Equipment in Naga City and Providing Penalties Thereof.” For this purpose, an amendment to the said Ordinance is necessary.

Likewise, a temporary extension of the waiver of the registration fee of farm machineries is likewise in order given the financial difficulties faced by farmers due to the fuel crisis and the steep increase in the cost of farm inputs. The extension of the waiver will help facilitate the registration of their farm machineries. Machinery registration is a requirement for the availment of fuel subsidies and other forms of assistance from the national government.

Be it ordained therefore by the Sangguniang Panlungsod of Naga City in session assembled, that:

SECTION 1.

All references in Ordinance No. 2023-006 to the “City Agriculture Office” or to “CAgo” shall henceforth refer to, or be substituted by the word, “Agricultural Biosystems Engineering Division” or with “ABED,” respectively.

SECTION 2.

Section 3 of Ordinance No. 2023-006 is herein amended to read as follows:

SECTION 3. REGISTRY OF AGRICULTURAL AND FISHERIES MACHINERY AND EQUIPMENT. — The Agricultural & Biosystems Engineering Division (ABED) shall maintain and update a registry of agricultural and fishery machinery and equipment in accordance with Joint Memorandum Circular No. 2018-02 issued by the Department of Agriculture and the Department of the Interior and Local Government, and any subsequent amendments thereto or national issuances on the matter.

The list of newly registered agricultural and fisheries machinery and equipment with complete information shall be uploaded to the server of the Philippine Center for Post-Harvest Development and Mechanization Agricultural and Fisheries Mechanization and Engineering Resource Network (PhilMech AFMechERN), copy furnished the Provincial Agriculture Office for consolidation.

The machinery owner shall report to ABED any registered machinery and equipment which are no longer operational so that these can be deleted from the registry.

SECTION 3. (Note: Section 4 of amending Ordinance)

Section 5 of Ordinance No. 2023-006 is herein amended by adding as one of the acceptable proofs of acquisition or ownership:

“v. Certificate of Donation”

and renumbering the succeeding two items from “v” and “vi” to “vi” and “vii.”

SECTION 4. (Note: Section 5 of amending Ordinance)

The payment of farm machinery registration fee is herein waived retroactive to one year after the date of effectivity of Ordinance No. 2023-006 and to extend until December 31, 2027. For this purpose, Section 7 of Ordinance No. 2023-006 is herein amended to read as follows:

SECTION 7. REGISTRATION FEE. — Free Registration is extended to December 31, 2027 due to the fuel crisis and high input cost affecting farmers and the owners of agri-machinery and equipment. After 2027, the amount of P300.00 shall be collected from the owner of any new or unregistered machinery or equipment.

The machineries and equipment owned by cooperatives duly registered under Republic Act No. 6810 (Magna Carta for Countryside and Barangay Business Enterprises) and Republic Act No. 6938 (Cooperative Code of the Philippines) shall be exempt from payment of registration fees pursuant to Section 133 of the Local Government Code of the Philippines.

SECTION 5. (Note: Section 6 of amending Ordinance)

Section 10 of Ordinance No. 2023-006 is herein amended to read as follows:

SECTION 10. SECTION 8. (Note: Section 9 of amending Ordinance)

EFFECTIVITY. This ordinance shall take effect ten (10) days from the date a copy thereof is posted in a bulletin board at the entrance of city hall and in at least two (2) other conspicuous places in the city.
