ORDINANCE NO. 2026-026

AN ORDINANCE REQUIRING ALL NATIONAL GOVERNMENT AGENCIES, OFFICES AND GOVERNMENT CORPORATIONS TO COORDINATE WITH THE NAGA CITY GOVERNMENT ALL PROJECT PLANNING AND IMPLEMENTATION TO BE INTRODUCED, ROLLED OUT OR IMPLEMENTED WITHIN NAGA CITY:

WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides for the provisions on Intergovernmental Relations (IGR) under Chapter III, Article I National Government and Local Government Units;

WHEREAS, it is provided further under the Local Government Code of 1991, Chapter III, Section 25, (b) that: National agencies and offices with project implementation functions shall coordinate with one another and with the local government units concerned in the discharge of these functions. They shall ensure the participation of local government units both in the planning and implementation of said national projects.”;

WHEREAS, despite the Local Government Code provision and its implementing rules and regulations by the Department of the Interior and Local Government (DILG), the said provision has not been made fully executing in Naga City;

WHEREAS, the essence of IGR is to facilitate cooperation and collaboration between the different orders of the government to avoid confusion, duplication of delivery of services, duplication of policymaking, utilization of resources, data sharing, among others. Such collaboration and cooperation commence from the policy formulation stage and the implementation stage of a project.

WHEREAS, it is both beneficial to the national government and the local government to have cooperation and collaboration in the planning, policy formulation, and implementation of projects and programs.

NOW, THEREFORE, be it ordained by the 15th Sangguniang Panlungsod in regular session assembled:

SECTION 1. TITLE. This Ordinance shall be known as the “National and Local Government Project Coordination Ordinance.”

SECTION 2. DEFINITION OF TERMS.

a. Intergovernmental Relations (IGR) – important interactions between governmental units of all types and levels. The interaction of institutions at national and local levels to enable the various parts of government to institutionalize cooperation that seeks to address the relations of equality and interdependence.

b. Coordination – shall mean collaboration and cooperation in the policy formulation stage and during the implementation stage. It shall also mean the submission of information regarding a program or project initiative of the national government that has come to the awareness of the Naga City agency or office in relation to their governmental function.

c. Initiative – any program, project, improvement, infrastructure, temporary or permanent, which implementation is planned to be within Naga City jurisdiction, in whole or in part.

SECTION 3. COORDINATION BY NATIONAL AGENCIES AND OFFICES. National agencies offices and government corporation which programs or projects are to be implemented within Naga City shall coordinate with the Naga City Government through written correspondence with relevant information of the initiative or project to the Office of the City Mayor.

SECTION 4. COORDINATION BY NAGA CITY DEPARTMENTS AND OFFICES. City Government departments and offices with national agency counterparts—such as the City Agriculture Office for the Department of Agriculture, Environment and Natural Resources Office for the Department of the Environment and Natural Resources, and the City Health Office for the Department of Health—shall coordinate with their counterpart national agency to determine the proposed national programs and projects intended for Naga City for the ensuing year. The heads of these departments and offices shall list these programs and projects with their corresponding cost and submit the same to the City Mayor and to the City Planning and Development Office (CPDO).

SECTION 5. INCLUSION IN THE CITY DEVELOPMENT PLAN AND ANNUAL INVESTMENT PROGRAMS. Upon receipt of the initial list of projects for the ensuing year as proposed by national agencies, the CPDO shall determine their alignment with the City Development Plan (CDP), and if found to be aligned with the CDP, shall cause their inclusion in the said plan as well as in the Local Development Investment Program and in the Annual Investment Program for the ensuing year. The City Development Council shall be convened for this purpose. The concerned national agencies shall be invited in the CDC meeting to present and discuss the details, and for possible fine-tuning any of their proposed programs or projects not in consonance with the CDP so that the same may likewise be incorporated therein and in the city’s investment programs.

SECTION 6. LIST OF FUNDED PROJECTS. Upon approval of the General Appropriations Act (GAA), the heads of the same city government departments and offices shall determine which of the initial programs and projects were funded in the national budget, including any new program or project added in the course of approving the GAA, and to submit an updated list of nationally funded programs and projects for the city to the CMO and the CPDO. They shall also endeavor to obtain the program/project briefs, implementation period, and plans if civil work projects, and their cost estimates, and furnish the same to the CMO and the City Project Monitoring Committee.

SECTION 7. CERTIFICATION OF COORDINATION. Prior implementation of any project or initiative by national government agencies, offices and government corporation, a Certification of Coordination issued by the Office of the City Mayor shall be required. Provided that no permit, clearance or any other document issued by the Naga City Government in relation to projects within Naga City shall be granted to national projects without presentation of Certificate of Coordination with the Office of the City Mayor.

SECTION 8. ISSUANCE OF PERMITS. Permits and clearances for national projects shall be issued by the respective Naga City office only upon proof that the particular initiative or project is covered by a certificate of coordination.

SECTION 9. IMPLEMENTING OFFICE. The City Planning and Development Office is directed to formulate guidelines in the implementation of this Ordinance. The same Department shall be made the repository of all information and reports gathered through this Ordinance.

SECTION 10. INTERPRETATION. In case of doubt or ambiguity in the interpretation of this Ordinance, it is understood that the paramount purpose is to avoid project duplication, planning and budgetary inefficiency, purpose inconsistencies and that the interpretation in favor of greater benefit of the people of Naga City shall prevail.

SECTION 11. REPEALING CLAUSE. All ordinances, resolutions, local executive orders, rules and regulations, or any part thereof inconsistent herewith, are deemed repealed, modified or amended accordingly. Provided, that any projects undertaken by national government or agencies without certificate of coordination as required in this ordinance may be subject to the city’s exercise of stoppage or desist orders as any other projects within Naga City.

SECTION 12. SEPARABILITY. In case any provision of this Ordinance is declared unconstitutional or invalid, the other provisions hereof, which are not affected thereby shall remain in full force and effect.

SECTION 13. EFFECTIVITY CLAUSE. This Ordinance shall take effect immediately upon its approval.
