AN ORDINANCE GRANTING A CLIMATE EXPOSURE AND HAZARD ALLOWANCE (CEHA) IN THE AMOUNT OF ONE HUNDRED PESOS (P100.00) PER DAY OF ACTUAL FIELD DUTY TO JOB ORDER AND CONTRACT OF SERVICE PERSONNEL WHOSE REGULAR DUTIES EXPOSE THEM TO THE ELEMENTS AND WHOSE COMPENSATION ARE BELOW THAT OF AN ENTRY LEVEL CASUAL:

BE IT ORDAINED by the Sangguniang Panlungsod of the City of Naga in session assembled:

SECTION 1. SHORT TITLE. This Ordinance shall be known as the “Naga City Climate Exposure and Hazard Allowance (CEHA) Ordinance of 2026.”

SECTION 2. DECLARATION OF POLICY. It is the policy of the City of Naga to promote social justice and uphold the dignity of labor, especially for workers in vulnerable employment status; recognize the occupational hazards posed by climate change, including heat stress and pollution, and exposure to waste; and ensure the efficiency of essential public services by maintaining the morale and physical well-being of frontline personnel.

SECTION 3. COVERAGE. This Ordinance shall apply strictly to personnel engaged by the City Government of Naga under Job Order (JO) or Contract of Service (COS) status whose compensation is below the daily rate for Salary Grade 1, Step 1 and whose office assignment and functions are the following:

a. Solid Waste Management Office: Street sweeper/street cleaner, garbage collector, garbage truck drivers, equipment operators and support personnel at the sanitary landfill; b. Public Safety Office: Traffic enforcers and traffic aides actually deployed on the streets: c. City Engineer’s Office: Kamineros and declogger personnel d. City Veterinary Office: Dog catchers and vaccinators e. Environment and Natural Resources Office: Snake catchers and river cleaners f. General Services Department: Streetlight crew

Provided that the entitlement to the CEHA shall be limited to the actual number of days a personnel is exposed to the elements in the performance of his or her designated functions as enumerated above.

SECTION 4. EXCLUSION. Job order and contract of service personnel of the above offices assigned to purely clerical, administrative, or indoor utility functions, or are only intermittently deployed outside or on the field, or are receiving compensation equivalent to or higher than Salary Grade 1, Step 1, are excluded from the coverage of this Ordinance.

SECTION 5. DEFINITION OF TERMS.

a. Actual Field Duty – Refers to the continuous performance of assigned tasks in an outdoor setting, exposed to the elements, for a duration of not less than six (6) hours per day, inclusive of breaks.

b. Climate Exposure and Hazard Allowance (CEHA) A financial grant to compensate city government personnel working in outdoor environments and exposed to the elements for the most part of their duty hours who are compensated below the entry-level pay for city government employees (Salary Grade 1, Step 1) although they are receiving the minimum wage or higher.

c. Contract of Service personnel – individual engaged to perform specific work or technical jobs requiring special skills not available within the agency

d. Job Order – As defined in CSC-COA-DBM Joint Circular No. 1, s. 2017, refers to piece work or intermittent jobs of short duration and pay is on a daily or hourly basis.

SECTION 5. GRANT OF ALLOWANCE. A Climate Exposure and Hazard Allowance in the amount of ONE HUNDRED PESOS (P100.00) per day is herein granted to qualified personnel for each day of Actual Field Duty.

The payroll or voucher for CEHA shall include as supporting documents: (a) the Office Order signed by the head of office and approved by the City Mayor indicating therein the names of the personnel, their job description, their place and usual time of duty, and their entitlement to CEHA and (b) a Certification from the Head of Office that the personnel claiming the CEHA for a particular payroll period rendered Actual Field Duty as defined herein.

SECTION 6. LIMITATIONS AND CONDITIONS. The CEHA shall have the following limitations and conditions:

a. No Work, No Pay. The CEHA shall only be paid for days actually worked. It shall not be paid during absences, or holidays where no duty was rendered.

b. Not a Wage Increase. The CEHA is distinct from the basic daily wage. It shall be recorded in the payroll as a separate allowance or premium.

c. No Employer-Employee Relationship. The grant of CEHA shall not be construed as establishing an employer-employee relationship, nor shall it create a vested right to permanent employment or civil service eligibility.

d. Maximum Compensation Cap. In no case shall the total daily compensation (JO/COS wage + CEHA) of a JO/COS personnel exceed the daily equivalent of Salary Grade 1, Step 1 of the prevailing Salary Schedule for First Class Cities.

e. CEHA shall not be included in the computation of the mid-year and year-end benefits.

SECTION 7. FUNDING SOURCE. The necessary amount shall be included in the Annual Budget of the City.

SECTION 8. IMPLEMENTING GUIDELINES. The City Human Resource Management Office, in coordination with the City Treasurer, the City Accountant, and the heads of offices with grantees of this allowance, shall formulate the specific guidelines for the processing of claims.

SECTION 9. SEPARABILITY CLAUSE. – If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof which are not affected thereby shall continue to be in full force and effect.

SECTION 10. EFFECTIVITY. – This ordinance shall take effect Five (5) days upon approval and publication in a newspaper of local circulation and posting at the official social media account of the City Government of Naga.
