AN ORDINANCE REGULATING THE PROPER HANDLING AND DISPOSAL OF USED OIL AND GREASE TRAP OF ALL THE ESTABLISHMENTS IN THE CITY OF NAGA AND PROVIDING PENALTIES FOR VIOLATION THEREOF: –

EXPLANATORY NOTE

The improper handling and disposal of used oil-whether from industrial processes or cooking-and grease trap waste poses a significant threat to public health and the environment. These pollutants can clog and damage sewerage systems, contaminate soil and water sources, and contribute to both air and water pollution. Without proper regulation and enforcement, these wastes can undermine sanitation infrastructure, increase disaster risks, and degrade the quality of life in urban communities.

In Naga City, the absence of a localized regulatory framework has made it difficult to monitor and control the generation, collection, and disposal of used oil and grease trap waste. Used oil, when discharged into waterways or soil, can contaminate water sources, harm aquatic life, and contribute to long-term ecological degradation. Similarly, unregulated grease trap waste from food establishments can clog drainage systems, cause flooding, and create unsanitary conditions that endanger public health.

LEGAL BASIS

This ordinance is enacted pursuant to the following national laws and policies:

  • Republic Act No. 9003 – Ecological Solid Waste Management Act  of 2000
  • Republic Act No. 9275 – Philippine Clean Water Act of 2004
  • Republic Act No. 6969 – Toxic Substances and Hazardous and Nuclear Waste Control Act of 1990
  • Republic Act of No. 7160 – Local Government Code of 1991

This proposed ordinance seeks to address these challenges by establishing clear guidelines and responsibilities for the proper storage, collection, transport, recycling, and disposal of used oil and grease trap waste. It empowers the City Environment and Natural Resources Office (CENRO) to identify waste generators, accredit transporters and processors, and enforce compliance through registration and permitting systems. By institutionalizing these measures, the City Government of Naga aims to promote environmental sustainability, safeguard public health, and ensure that all stakeholders-particularly waste generators and handlers-are held accountable for their role in maintaining a clean and healthy urban environment.

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. TITLE – This ordinance shall be known as the “Used Oil and Grease Trap Waste Management Ordinance of Naga City.”

SECTION 2. PURPOSE – To promote public health, protect the environment, and ensure proper waste management practices by regulating the handling and disposal of used oil and grease trap waste.

SECTION 3. SCOPE – This ordinance applies to all food establishments, automotive shops, commercial and industrial entities that generate used oil or grease trap wastes within Naga City.

SECTION 4. Definition of Terms

  • Used Oil – Any petroleum-based or synthetic oil that has been used and is no longer suitable for its original purpose.
  • Grease Trap Waste – Fat, oil, and grease (FOG) collected from grease traps installed in kitchens or food establishments.
  • Accredited Waste Collector – A person or company accredited by the City Environment and Natural Resources Office (CENRO) to collect and dispose of used oil and grease trap waste.
  • Generator – Any person, household, or establishment that produces used oil or grease trap waste.
  • TSD Facility – A Treatment, Storage, and Disposal facility duly accredited by the Department of Environment and Natural Resources (DENR).
  • Establishment – Any business, commercial, institutional, ΟΙ industrial entity, whether public or private, that generates used oil or grease trap waste as part of its operations, including but not limited to restaurants, food outlets, eateries, hotels, food processors, canteens, automotive repair shops, manufacturing plants, and similar entities.

SECTION 5. RESPONSIBILITIES OF GENERATORS – All generators must:

  • Store used oil and grease trap waste in sealed, labeled containers
  • Prevent spills, leaks, and contamination
  • Clean and maintain grease traps regularly
  • Coordinate with authorized collectors for proper disposal
  • Maintain records of waste generation and disposal
  • Register their accredited waste transporter with the City Environment and Natural Resources Office (CENRO)

SECTION 6. COLLECTION, RECYCLING, AND DISPOSAL

  • Only authorized collectors accredited by CENRO may collect and transport used oil and grease trap waste . Disposal must be done at approved treatment recycling facilities

  • All cooking and industrial used oil and grease trap waste shall be recycled, transported, stored, and disposed of only through an accredited waste transporter and/or a Treatment, Storage, and Disposal (TSD) facility duly accredited by the Department of Environment and Natural Resources (DENR)

  • Dumping into drainage systems, canals, soil, or water bodies is strictly prohibited

SECTION 7. REGISTRATION AND PERMITS –

  • Within sixty (60) days from the effectivity of this ordinance, all establishments generating used oil and/or grease trap waste shall register with the City Environment and Natural Resources Office (CENRO) and declare their designated waste collector or transporter

  • All transporters and processors of used oil and/or grease trap waste must secure an accreditation permit from CENRO prior to operating within Naga City

  • The requirements and procedures for accreditation shall be determined by CENRO, in accordance with applicable environmental laws and standards

SECTION 8. ENFORCEMENT AND MONITORING – The City Environment and Natural Resources Office (CENRO) shall:

  1. Oversee implementation and enforcement of this ordinance

  2. Accredit collectors and disposal facilities

  3. Conduct inspections and monitoring

  4. Provide education and training to stakeholders

  5. Identify and maintain a registry of all used oil and grease trap waste generators in Naga City

  6. Publicize the list of accredited waste collectors and transporters through appropriate channels, including the city website, bulletin boards, and public advisories

  7. Issue citation tickets to establishments and waste transporters found violating any provision of this ordinance

  8. Formulate the necessary Implementing Rules and Regulations (IRR) within fifteen (15) days upon approval of this ordinance to effectively carry out its implementation

SECTION 9. PROHIBITED ACTS – The following acts are prohibited:

  1. Dumping or discharging used oil or grease trap waste into public drainage, waterways, or open land

  2. Burning used oil or grease trap waste

  3. Using used oil for cooking or food preparation

  4. Selling or giving away used oil for unauthorized reuse

  5. Failure to maintain grease traps or allowing overflow

  6. Unauthorized collection, transport, or disposal of waste

  7. Failure of any generator to register their accredited waste transporter with the City Environment and Natural Resources Office (CENRO) within the prescribed period

  8. Failure of any accredited Waste Collector and Transporter to register with CENRO.

SECTION 10. PENALTIES – Violators shall be subject to the following: .

  • First Offense: Fine of Two Thousand Pesos (P2,000.00)
  • Second Offense: Fine of Four Thousand Pesos (P4,000.00)
  • Third Offense: Fine of Five Thousand Pesos (5,000.00), revocation of business permit and/or imprisonment of not more than thirty (30) days, at the discretion of the court

SECTION 11. SEPARABILITY CLAUSE – If any provision of this ordinance is declared invalid, the remaining provisions shall remain in effect.

SECTION 12. EFFECTIVITY – This ordinance shall take effect fifteen (15) days upon approval and publication in a newspaper of local circulation and posting at the official social media account of the City Government of Naga.
