ORDINANCE NO. 2026-004

AN ORDINANCE PRESCRIBING THE RATES OF RENTAL FOR THE USE OF FARM MACHINERIES AND POST-HARVEST FACILITIES AT THE CITY NURSERY AND PROVIDING FOR THE SUPPORT MECHANISM NECESSARY FOR THEIR SUSTAINED AND RELIABLE OPERATION:-

Be it ordained by the Sangguniang Panlungsod of Naga City that:

SECTION 1. Rental Rate. The following rental rates are hereby imposed for the use of city-owned agricultural and post-harvest machineries at the City Nursery Compound:

a. 6-ton Recirculating Dryer Ninety centavos (P0.90) per kilo of palay; b. 12-ton Recirculating Dryer Ninety centavos (P0.90) per kilo of palay; c. 12-ton Recirculating Dryer (Village Type Corn Post Harvest Facility) Ninety centavos (P0.90) per kilo of corn without cob; d. Rice Mill Two Pesos and Fifty centavos (P2.50) per kilo; e. 4WD Tractor 36hp Nine hundred pesos (P900.00) per hour; f. 4WD Tractor 55hp One Thousand one hundred (P1,100.00) pesos per hour; g. 4WD Tractor 95hp One Thousand three hundred pesos (P1,300.00) per hour; h. Rice Combine Harvester Sixty pesos (P60.00) per sack i. Truck Ten pesos (P10.00) per sack, within Naga City only

SECTION 2. Mandate of the Agricultural and Biosystems Engineering Division. The City Agricultural and Biosystems Engineering Division (ABED), created by virtue of Ordinance No. 2025-013, is herein designated as the custodian of the city’s farm machineries and post-harvest facilities as well as of all other property, plant and equipment within its designated area at the City Nursery.

For the purpose of this Ordinance, it shall serve as a catalyst in uplifting the lives of the city’s farmers by way of providing them with dependable, reliable, affordable and timely service.

SECTION 3. Collection. The collection of rental fees for the use of these farm machineries and post-harvest facilities shall be done by the designated duly bonded personnel of ABED and the remittance of collections shall be subject to existing accounting and auditing rules and regulations.

SECTION 4. Organizational Structure. ABED shall submit to the Human Resource and Management Office an expanded organizational structure to include the technical and support personnel who will run and maintain the farm machineries, post-harvest facilities and other ancillary and support equipment. These will be in addition to the positions already created under Ordinance No. 2025-013. Such expanded organizational structure shall define the minimum qualifications and functions of the additional positions consistent with its needs and with civil service rules and regulations and shall be the basis for the hiring of new personnel or the promotion of existing ones.

SECTION 5. Budgetary Support. To ensure farmers receive reliable and sustained service from the agricultural and post-harvest machineries of the city government, ABED shall be allocated its own budget separate from the City Agriculture Office.

Such budgetary allocation shall cover the maintenance and operation of the machineries, the stocking of fast moving spare parts, training of operators, administrative expenses, building maintenance and construction if expansion is needed, subject to the usual planning and budgeting cycle and processes.

Upon effectivity of this Ordinance and without waiting for the annual budgeting process to commence, ABED shall immediately prepare the necessary investment program and budget proposal to either repair, restore, or replace its farm machineries, post-harvest facilities, ancillary equipment and dilapidated structures, as well as the acquisition of new ones, in order to raise its level of service to local farmers.

Such investment program and budget proposal shall contain only such programs, projects and activities with outcomes aligned with the City Development Plan and the current 2028 Finish Lines. The same shall be submitted to the City Planning and Development Office for consideration by the City Development Council and possible endorsement by the City Mayor to the Sangguniang Panlungsod for funding from any available savings or underestimated income.

SECTION 6. Property Management. A complete inventory of all property, plant and equipment of ABED, whether functional or not, shall immediately be conducted and properly recorded, copy furnished the General Services Department and the City Accounting Office. Those which are no longer needed or have reached the end of their useful life shall be disposed prior to the end of 2026 in accordance with existing property management regulations. For this purpose, the General Services Division, City Accounting Office and the Internal Audit Service shall extend assistance to ABED upon its request.

SECTION 7. Transition to Local Economic Enterprise. If warranted by its income and the objective findings of a feasibility study, ABED may be converted into a local economic enterprise upon favorable endorsement of the City Mayor.

SECTION 8. Separability Clause. If, for any reason, any part or provision of this Ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect.

SECTION 9. Repealing Clause. All ordinances, resolutions, executive orders, or regulations and other issuances inconsistent with the provisions of this Ordinance are hereby repealed, amended, or modified accordingly.

SECTION 10. Effectivity. This ordinance shall take effect after posting at city hall and on the city government’s website and social media account and publication for three days in a newspaper of local circulation.
