ORDINANCE No. 2025-128

AN ORDINANCE RATIONALIZING THE REGISTRATION AND USE OF EBIKES OR MICRO-MOBILITY VEHICLES IN THE CITY OF NAGA, THEREBY AMENDING THE CITY ORDINANCE NO. 2023-030 ENTITLED, “AN ORDINANCE REQUIRING THE REGISTRATION OF EBIKES IN THE CITY OF NAGA, PROVIDING GUIDELINES AND PENALTIES FOR ITS IMPLEMENTATION, AND OTHER PURPOSES,” AND ORDINANCE NO. 2024-113 ENTITLED, “AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO. 2023-030, PROVIDING GUIDELINES AND PENALTIES FOR ITS IMPLEMENTATION, AND FOR OTHER PURPOSES”

WHEREAS, Section 16, Chapter II, Title One of Republic Act No. 7160, also known as the Local Government Code of 1991, mandates local government units (LGUs) to ensure the promotion of the general welfare of their inhabitants; 

WHEREAS, Republic Act No. 11697, otherwise known as the “Electric Vehicle Industry Development Act (EVIDA),” promotes the adoption of electric vehicles and requires local governments to ensure their safe use and regulation; 

WHEREAS, Land Transportation Office (LTO) Administrative Order No. VDM-2024-044 and other related issuances prescribe the operational limitations, classification, and registration of e-bikes and similar vehicles; 

WHEREAS, there have been reports of violations of City Ordinance No. 2023-030 by owners and users of e-bikes, particularly concerning their use as colorum public utility vehicles (PUVs), creating unfair competition with legitimate tricycle operators and endangering public safety; 

WHEREAS, there is a need to update and rationalize the regulation of e-bikes in Naga City to harmonize with national laws, promote sustainable mobility, protect livelihoods, and ensure road safety; 

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of Naga in session assembled, that: 

SECTION 1. DEFINITION OF TERMS. For purposes of this Ordinance, the following terms shall mean: 

  1. Light EV refers to EVs such as electric scooters, electric bicycles, electric personal transport, and other similar vehicles weighing less than fifty kilograms (50 kgs). 
  2. E-Bike a two or three-wheeled electric motor-assisted vehicle designed for short trips and local commuting, with maximum design speed not exceeding 50 kph. 
  3. E-Trike an electric tricycle designed for passenger or goods transport.
  4. E-Scooter a stand-up or seated electric-powered scooter for short-distance travel. 
  5. Micromobility refers to alternative modes of transportation which are provided by Light EVs. 
  6. Micro-Mobility Vehicle includes e-bikes, e-trikes, e-scooters, and similar small electric vehicles.
  7. Public Roads shall mean every public thoroughfare, public boulevard, driveway, avenue, park, and alley, but shall not include roadway upon grounds owned by private persons, colleges, universities, or other similar institutions as defined under R.A. 4136. 
  8. National Roads and Highways roads that form part of the main trunk-line system and are under the administrative jurisdiction of the Department of Public Works and Highways (DPWH), a sectoral agency of the Department of Transportation (DOTr). National roads are further classified by the DPWH into: 
    • a) Primary Roads: Form the main trunkline or backbone, such as the Pan-Philippine Highway (AH26, also known as Maharlika Highway or N1). For purposes of this Ordinance, the Almeda Highway and Diversion are included.
    • b) Secondary Roads: Connect cities directly to national primary roads, major ports, airports, and provincial capitals. 
    • c) Tertiary Roads: Other existing roads under the DPWH that perform a local function. 
  9. Resident a person who is a registered voter or has proof of domicile in Naga City. 
  10. Colorum PUV Operation use of a vehicle (e.g. e-bike) as a public utility vehicle without the required franchise from government authorities, which pose risk to public safety. 
  11. Registration the process of recording e-bikes with the City Government of Naga through the Naga City Bike Board. 
  12. Permit to Operate authority to use or operate the registered e-bike granted upon registration. 
  13. Driver’s License (DL) an authority in the form prescribed by the LTO granted to a person to operate motor vehicle that is either non-professional or professional (Section 3 (c) of the IRR of RA 10930). 

SECTION 2. GUIDELINES ON REGISTRATION OF EBIKES IN NAGA CITY. The Section 4 of ORDINANCE NO. 2023-030 otherwise known as “AN ORDINANCE REQUIRING THE REGISTRATION OF E-BIKES IN THE CITY OF NAGA, PROVIDING GUIDELINES AND PENALTIES FOR ITS IMPLEMENTATION, AND FOR OTHER PURPOSES,” is hereby amended, now to read as follows: 

A. Registration shall be facilitated by the City Treasurer’s Office through the Naga City Bike Board. The following shall be presented upon registration: 

    1. Government-issued ID with picture and address; 
    2. Voter’s Certificate or utility bill as proof of residency in Naga City;
    3. Proof of Ownership;
    4. Certificate of Attendance in a Road Safety Seminar conducted by the City Government of Naga through the Naga City Bike Board;  and
    5. Registration and renewal of registration shall be done in person by the owner/operators. 

B. E-bikes registered in Naga City shall be operated only within the limits of the City’s territory. Unregistered e-bikes are prohibited in public roads and major thoroughfares of Naga City. 

C. E-bikes registered by other LGUs shall be subject to city ordinances and regulations when in Naga. 

D. E-bike registration shall be renewed annually, when expired. All e-bikes operating in Naga City are hereby required to register in the local government of Naga. The City Treasurer’s Office through the Naga City Bike Board shall cause the registration of the same. 

E. Section 1 of the City Ordinance No. 2024-113, “AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO. 2023-030 OTHERWISE KNOWN AS AN ORDINANCE REQUIRING THE REGISTRATION OF E-BIKES IN THE CITY OF NAGA, PROVIDING GUIDELINES AND PENALTIES FOR ITS IMPLEMENTATION, AND FOR OTHER PURPOSES,” is also hereby amended in this ordinance, to wit:

SECTION 3. USE OF E-BIKES IN NAGA CITY. The Section 5 of ORDINANCE NO. 2023-030 otherwise known as “AN ORDINANCE REQUIRING THE REGISTRATION OF E-BIKES IN THE CITY OF NAGA, PROVIDING GUIDELINES AND PENALTIES FOR ITS IMPLEMENTATION, AND FOR OTHER PURPOSES,” is hereby amended, now to read as follows:

A. Ideally, e-bikes are to be used mainly for short distances such as within subdivisions as stipulated in the Land Transportation Office Administrative Order No. 2021-039. All operators/drivers of E-bikes (LEV) must have a valid LTO Driver’s License when driving on public roads. 

B. All E-bikes/E-trikes intended for use as PUV must be registered (as PUV) with LTO.They shall not be used as public utility vehicles without proper franchise or authority. 

C. All drivers of e-bikes/e-trikes operating on or using public roads must have a valid e-bike operator’s permit and a driver’s license issued by LTO. 

D. The Homeowners Association of respective subdivisions and villages are required to coordinate with the LGU of Naga with respect to their internal policies regarding operation of e-bikes and other micro-mobility vehicles in their locality. 

E. Operators shall observe the following safety requirements:

    1. Wearing of appropriate protective helmet and reflectorized gear for two-wheeled e-bikes and/or units whereby operator/driver and passenger are exposed. 
    2. Use of front and rear lights, signal lights, and functional brakes. 
    3. If the passenger is a child, use a secured, certified child seat or carrier appropriate for the child’s age and weight. 
    4. Compliance with maximum speed limits: 22 kph in barangay roads, 15 kph in shared lanes/pedestrian areas. 
    5. Drivers must be at least eighteen (18) years old. 
    6. Use of E-bikes are preferably within private roads and for short distances. However, they may be operated on public roads/highways with precautions. They may be operated on national roads and highways within the limits of Naga City only if there are demarcated bike lanes. 
    7. When used on two-way public roads/streets, they shall occupy the outermost lane or road space. 
    8. Adhere to the Light EV’s passenger count and maximum weight capacity, depending on the manufacturer’s design. 

F. Preferably, operators/users of e-bikes or micro-mobility EVs on public roads are covered by personal insurance. 

 

SECTION 4. NAGA CITY NATIONAL ROADS AND HIGHWAYS. For purposes of this ordinance, the following are considered as National roads or highways in Naga City: 

  1. Primary Roads:
    1. Maharlika Highway (Del Rosario-Panganiban-Rotonda) 
    2. Almeda Highway 
    3. Diversion Road (Roxas Avenue) 
    4. C5 Mabolo Felix Plazo 
  2. Secondary Roads:
    1. Magsaysay Avenue M.T. Villanueva Avenue-Queborac Road 
    2. Bagumbayan Road 
    3. Balatas-Cararayan-San Isidro-Carolina 
    4. San Felipe-Pacol-Carolina-Panicuason Road
    5. Abella-Queborac
  3. Tertiary Roads: Other roads in Naga City that are under DPWH coverage.

SECTION 5. ENFORCEMENT. The Public Safety Office (PSO), Philippine National Police (PNP), and deputized barangay enforcers shall strictly enforce this Ordinance. Local traffic rules and regulations/ordinances shall apply when the e-bike is operated/used on public roads/highways. Appropriate coordination shall be made with the Land Transportation Office. 

SECTION 6. PENALTIES. The Section 9 of ORDINANCE NO. 2023-030 otherwise known as “AN ORDINANCE REQUIRING THE REGISTRATION OF E-BIKES IN THE CITY OF NAGA, PROVIDING GUIDELINES AND PENALTIES FOR ITS IMPLEMENTATION, AND FOR OTHER PURPOSES,” is hereby amended, now to read as follows: 

  1. Unregistered E-Bike
    • a) 1st Offense: Warning 
    • b) 2nd Offense: ₱1,000 fine 
    • c) 3rd and succeeding offenses: ₱2,000 
  2. Use as Colorum PUV
    • a) 1st Offense: ₱1,000 fine 
    • b) 2nd and subsequent violations: ₱2,000 fine and impoundment until fine is settled 
  3. Reckless/Dangerous Operation
    • a) 1st Offense: ₱500 fine 
    • b) 2nd Offense: ₱1,000 fine 
    • c) 3rd and succeeding offenses: ₱2,000 fine and road safety seminar 
  4. Underage Driving
    • a) 1st Offense: Warning to driver or parent/guardian 
    • b) 2nd and succeeding offenses: ₱500 fine per offense 
  5. Violation of Safety Requirements
    • a) ₱500 fine per offense 
  6. Expired Registration
    • a) ₱200 fine on late renewal
    • b) ₱500 fine per apprehension (if less than one (1) year expiry)
    • c) ₱1,000 fine per apprehension for unrenewed registration after more than one (1) year expired. 
  7. Unpaid penalties/fines after 72 hours after apprehension may be a basis for the filing of case in court. 

 

SECTION 7. SUSTAINABILITY MEASURES. The City Government shall: 

A. Develop and maintain bike lanes and e-bike friendly infrastructures. 

B. Paint/re-paint bike lanes through the City Engineer’s Office. 

C. Conduct consistent clearing of obstructions in the city’s bike lanes through the Public Safety office (PSO) and Naga City Police Office (NCPO). 

D. Establish designated charging stations in public areas.

E. Task the Naga City Bike Board to coordinate with the Department of Public Works and Highways, for the designation of allowable bike lanes, at specific portions of the national roads. 

F. Install signages in areas wherein e-bikes are prohibited or allowed to traverse. 

G. Promote awareness campaigns on safe and sustainable use of micro-mobility vehicles, e.g., e-bikes, through the city’s official circulations and media platforms. Moreover, ensure proper dissemination of information regarding e-bike operation and regulations in the city. 

SECTION 8. TRANSITIONAL PROVISION. Existing e-bike owners shall have one hundred twenty (120) days from the effectivity of this Ordinance to comply with the new requirements. 

SECTION 9. REPEALING CLAUSE All ordinances, rules and regulations or parts thereof in conflict with this Ordinance are hereby repealed, amended, or modified accordingly.

SECTION 10. EFFECTIVITY CLAUSE This ordinance shall take effect immediately upon approval.
