AN ORDINANCE AMENDING SECTIONS 58 AND 59 OF ORDINANCE NO. 93-049, AS AMENDED BY ORDINANCE NO. 94-016 AND ORDINANCE NO. 2019-055, OTHERWISE KNOWN AS THE “TRUCK BAN ORDINANCE OF NAGA CITY,” BY ADJUSTING THE TRUCK BAN TIME WINDOW, EXPANDING THE COVERAGE AREA, PROVIDING FOR REASONABLE EXEMPTIONS UNDER REGULATED CONDITIONS, AND OTHER PURPOSES:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga that:
SECTION 1. SHORT TITLE. This Ordinance shall be known as the Amended Truck Ban Ordinance of Naga City.
SECTION 2. DECLARATION OF POLICY. It is hereby declared the policy of the City Government of Naga to promote public safety, environmental protection, and efficient traffic flow by regulating the movement of heavy vehicles within the city’s main thoroughfares, particularly during peak hours of vehicular congestion.
SECTION 3. Section 58 of Ordinance No. 93-049 is hereby amended to read as follows:
“SECTION 58. TRUCK BAN REGULATIONS.
a) All freight trucks, vans, trailers, and other cargo vehicles with six wheels and above shall be prohibited from entering, traversing, or parking within the designated Truck Ban Zone of Naga City from 6:00 A.M. to 8:00 P.M., Mondays to Saturdays, except as otherwise provided in this Ordinance.
b) The Truck Ban Zone shall include the area within and be bounded by the following roads and corridors:
- Maharlika Highway
- Roxas Avenue
- Magsaysay Avenue
- Fraternidad Street
- Biak-na-Bato Street
- Elias Angeles Street
- Bagumbayan Road
- M.T. Villanueva Avenue
- Central Business District I (CBD I) area as defined in Ordinance No. 93-049
c) All 6-wheeler trucks and above are prohibited from passing through the portion of Roxas Avenue from Almeda Highway to Tabuco Junction from 6:00 A.M.-8:00 A.M., 11:00 A.M.-1:00 P.M., and 4:00 P.M.-7:00 P.M.
d) During the hours of the Truck Ban, covered vehicles may only traverse designated alternate routes, subject to the approval of the Naga City Urban Transport and Mobility Council (NCUTMC).
e) In the event of calamities and emergencies, the local Chief Executive may declare suspension of Truck Ban.
SECTION 4. EXEMPTIONS. The following shall be exempt from the Truck Ban, provided they are clearly marked and engaged in official or emergency functions:
- Fire trucks, ambulances, police and military vehicles, and other emergency response units;
- Utility, repair, and maintenance trucks performing essential services such as water, electricity, telecommunications, and road works;
- Garbage collection trucks and other city service vehicles;
- Delivery trucks carrying perishable goods and food products, such as ice cream and dairy during specified delivery windows approved by the City Mayor;
- Vehicles granted Special Permits by the City Mayor for oversized cargo, seasonal goods, or event-related logistics, subject to regulated conditions and coordination with the Public Safety Office.
- Delivery trucks that transport live fish and animals are allowed to pass through Almeda and Roxas Avenue.”
SECTION 5. PENALTY CLAUSE. Any person, driver, operator, or company found violating this Ordinance shall be subject to the following penalties:
- First Offense: P3,000.00 fine
- Second and Subsequent Offenses: P5,000.00 fine and possible impoundment of the violating vehicle until settlement of the prescribed fine.
The Public Safety Office shall be authorized to issue implementing guidelines for citation and enforcement.
SECTION 6. IMPLEMENTING RULES AND COORDINATION. The Naga City Urban Transport and Mobility Council (NCUTMC) and the Public Safety Office (PSO) shall promulgate implementing guidelines to ensure proper enforcement of this Ordinance and shall coordinate with concerned barangays, the Naga City Police Office, and the Land Transportation Office (LTO) for its effective implementation.
SECTION 7. MAP OF THE TRUCK BAN ZONE. Attached as “Annex A” and made an integral part of this Ordinance is the Updated Map of the Truck Ban Zone of Naga City, showing the delineation of the expanded coverage area, including Roxas Avenue, Magsaysay Avenue, Fraternidad Street, Biak-na-Bato Street, Bagumbayan Road, M.T. Villanueva Avenue, Elias Angeles Street, and CBD I boundaries.
The map was prepared and certified by the City Planning and Development Office (CPDO) using official city datasets and validated by the Naga City Urban Transport and Mobility Council.
SECTION 8. TRUCK BAN AWARENESS CAMPAIGN. The City Government shall undertake comprehensive information dissemination campaign on the provisions of this Ordinance, through various means, including but not limited to the city’s official social media platforms.
The City Government shall likewise allocate funds for the installation and maintenance of notices and directional signages necessary for the effective implementation of this Ordinance.
SECTION 9. REPEALING CLAUSE. All ordinances, resolutions, or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.
SECTION 10. SEPARABILITY CLAUSE. If any provision of this Ordinance is declared invalid or unconstitutional, the remaining provisions shall remain in full force and effect.
SECTION 11. EFFECTIVITY. This Ordinance shall take effect fifteen (15) days after its approval and publication in a newspaper of local circulation.
