ORDINANCE NO. 2025-093

AN ORDINANCE ESTABLISHING THE NAGA CITY SAFETY AND RESILIENCY INTERNET PROTOCOL (IP) CAMERAS PROGRAM WITH CITY-WIDE MONITORING, COVERING CRIME-PRONE, TRAFFIC CONGESTION-PRONE, FLOOD-PRONE, AND FIRE-PRONE AREAS, AS WELL AS CRITICAL INFRASTRUCTURES AND PUBLIC CONGREGATION SPACES, PROVIDING FUNDS THEREFOR, AND FOR OTHER PURPOSES:-

WHEREAS, the City of Naga is recognized as the Pilgrim City of the Philippines and a major center of commerce, culture, and governance in the Bicol Region;

WHEREAS, public safety, peace and order, traffic management, disaster resilience, and protection of critical infrastructures are vital to sustain the welfare of its residents, barangays, and visitors;

WHEREAS, Republic Act No. 7160 (Local Government Code) authorizes LGUs to enact measures to promote the general welfare of their constituents;

WHEREAS, the installation of a Citywide Internet Protocol (IP) Cameras Safety and Resiliency Network to be linked to the Center for Safety and Resiliency (CeSAR) Command Center will ensure effective monitoring, response, and coordination among peace and order enforcers, barangay peacekeepers, traffic units, and disaster management teams;

NOW, THEREFORE, be it ordained, as it is hereby ordained by the Sangguniang Panlungsod in session assembled:

SECTION 1. TITLE. This Ordinance shall be known as the “Naga City Safety and Resiliency Internet Protocol (IP) Cameras Ordinance.”

SECTION 2. DECLARATION OF POLICY. It is the policy of the City of Naga to harness technology for public safety, disaster resilience, evidence-based enforcement, protection of property, efficient traffic management, and respect for the right to privacy consistent with existing laws. The City Government, likewise, adheres to the DILG Memorandum Circular Order No. 2022-060, as well as Republic Act No. 10173 or the Data Privacy Act of 2012, and other relevant constitutional safeguards.

SECTION 3. COVERAGE. This Ordinance shall cover all government owned and operated IP Cameras, to wit:

a) All 27 barangays of Naga City, with IP Camera installations in crime-prone, flood-prone, fire-prone, and traffic congestion-prone areas;
b) Critical government infrastructures including City Hall, hospitals, markets, transport terminals, and educational institutions;
c) Significant public congregation areas such as church vicinity, plazas, Naga City People’s Mall, and critical procession/festival routes;
d) Major roads and highways within the jurisdiction of Naga City.

 SECTION 4. TECHNICAL STANDARDS. The IP Cameras system shall adopt the following minimum standards:

  • All equipment shall be Open Network Video Interface Format (ONVIF)-compliant and interoperable with the CeSAR’s Video Management System (VMS) with High-resolution (1080p or higher) cameras with night vision;
  • PTZ cameras at major intersections and plazas;
  • Weatherproof outdoor rating (IP66 or higher);
  • Fiber and wireless integration to the CESAR Command Center;
  • Storage redundancy (local central servers);

SECTION 5. MANAGEMENT AND OPERATION. The CeSAR Command Center shall serve as the central hub of the system, managed by the City Government technical committee through PSO Central Communications Center (ComCen), in close coordination with the PNP, BFP, PSO, and barangay authorities. Barangay-level feeds shall be integrated into the CESAR network.

SECTION 6. SYSTEM INTEGRATION AND STANDARDS.

(a) The City shall adopt uniform technical specifications covering resolution, low-light performance, analytics, cybersecurity, power backup and Coder-Decoder (CODEC) Protocol, storage/retention, as approved by the IP Camera Technical Committee created under this Ordinance.

(b) Barangay-owned cameras may be federated into the CESAR subject to compliance with the City’s minimum technical standards.

SECTION 7. DATA PRIVACY, ACCESS, AND RETENTION.

(a) The Program shall comply with RA 10173 (Data Privacy Act of 2012) and its IRR.
(b) IP Camera footage shall be used strictly for public safety, disaster/emergency response, traffic management, and lawful investigations.
(c) Access shall be role-based, logged, and limited to authorized personnel.
(d) Retention: minimum 30 days for general sites and 90 days for high-risk or LPR-covered sites, unless footage is preserved for an ongoing investigation or case.
(e) The City Data Protection Officer (DPO) shall conduct privacy impact assessments, ensure signage at covered areas, and recommend safeguards.
(f) Requests for footage shall follow prescribed protocols, including lawful orders/subpoenas where applicable.
(g) Issuances of the National Privacy Commission, such as NPC Circular No. 2024-02 and other related issuances, shall be adhered to.

SECTION 8. GOVERNANCE AND INTER-AGENCY COORDINATION.

(a) An IP Camera Technical and Oversight Committee is hereby created, chaired by the City Mayor or representative, SP Chairman on Peace and Order and Public Safety, and Public Safety Office as the Vice-Chairperson and Secretariat, with members from PNP, BFP, PNP-TEU, PSO-COMCEN, MDRRMO, City Legal Office, and Liga ng mga Barangay.
(b) The Committee shall: approve site plans, technical standards, acceptance testing, Standard Operating Procedures (SOPs), Key Performance Indicators (KPIs), and annual investment priorities; and recommend updates to keep pace with technology.
(c) The Technical and Oversight Committee is authorized to update specifications through resolutions without amending the ordinance.
(d) The committee shall likewise be responsible for performance measurements and reporting; evaluation regarding constitutional and due process safeguards and shall decide on the implementation capacity in relation to budgeting.

SECTION 9. OPERATIONS AND MAINTENANCE.

(a) The CeSAR Command Center shall house the 24/7 monitoring desk with PNP, BFP, TMC/PSO, and MDRRMO operators.
(b) Assigned personnel in charge with the monitoring of the IP Cameras System shall undergo a specialized and mandatory training program, which shall cover not only the technical aspect of handling the IP Cameras System, but as well as the proper handling of threat identification, incident reporting protocols, evidence preservation, and thorough understanding of data privacy laws.
(c) The City may enter into service/maintenance contracts with performance-based SLAs for uptime, repairs, and preventive maintenance.
(d) Deliberate damage, theft, or tampering of IP Camera equipment is prohibited and shall be penalized as provided herein, without prejudice to criminal liability under existing laws.

SECTION 10. FUNDING AND APPROPRIATION

(a) Appropriation Clause. The amount necessary for the initial implementation of this Ordinance, including procurement of cameras, network, storage, VMS, command center equipment, and related civil/electrical works, shall be charged against available funds of the City Government of Naga.
(b) Thereafter, such sums as may be necessary for continued implementation, operations and maintenance, upgrades, and expansion shall be included in the annual budget of the City Government, providing funds therefor, and may draw from national grants, PPPs, donations, and other lawful sources.

SECTION 11. ANNEXES. The following documents form part of this Ordinance as attachments, providing operational guidance and agreements for implementation.

  • Annex A- IP Cameras Implementation Plan
  • Annex B- Memorandum of Agreement with Barangays

These annexes shall be referenced in the interpretation and implementation of this Ordinance but shall remain as separate documents for flexibility of amendment and operational updates. Amendments thereof may be effected through Executive Acts, provided such executive amendments or updates are reported to the Sangguniang Panlungsod.

SECTION 12. AUTHORITY TO ENTER INTO A MEMORANDUM OF AGREEMENT FOR THE CITY MAYOR. The twenty-seven (27) barangays of the City of Naga are authorized and directed to enter into a Memorandum of Agreement (MOA) with the City Government of Naga, represented by the City Mayor, for the purpose of establishing cooperation, coordination, and accountability in the installation, operation, monitoring, and maintenance of the Internet Protocol (IP) Cameras system within their respective jurisdictions.

The said MOA shall define the respective duties and responsibilities of the City Government of Naga and the 27 barangays, which include but are not limited to the following:

  1. The integration of the barangay-level IP Cameras systems with the CeSAR Command Center;
  2. The designation of barangay personnel responsible for the management of the IP Cameras systems in their respective barangays;
  3. The procurement, technical, and logistical assistance by the City Government, and;
  4. The proper observance of the data privacy, security, and ethical handling of the IP Cameras footage in accordance with the RA No. 10173, or the Data Privacy Act of 2012, and other relevant laws and regulations that concern the privacy of the people.

SECTION 13. PROCUREMENT. Procurement shall comply with the Government Procurement Reform Act and may allow multi-year contracts, framework agreements, or lotting (by zones/technology) to optimize cost, ensure compatibility, and secure after-sales support.

SECTION 14. PENALTIES.

(a) Administrative fines of P5,000 per offense (if within LGU jurisdiction), and
(b) Cost of repairs, if requirement for the repair of damaged camera or equipment, shall likewise be charged to the offender.
(c) Prosecution under applicable penal laws (e.g., malicious mischief, theft) without prejudice to civil damages.

Business establishments mandated under separate ordinances to connect/allow camera views but who willfully obstruct enforcement may be sanctioned per their permits.

SECTION 15. REPORTING AND KPIs. The Committee shall submit to the Sangguniang Panlungsod a semi-annual report containing installation progress, uptime, incidents detected/resolved, response times, and privacy compliance metrics.

SECTION 16. IMPLEMENTING RULES AND REGULATIONS (IRR). Within 60 days from effectivity, the Committee shall issue the IRR detailing technical standards, SOPs, request and release procedures for footage, data retention schedules, and monitoring/evaluation frameworks.

SECTION 17. SEPARABILITY CLAUSE. In the event that any section of this Ordinance shall be held unconstitutional or invalid, other sections which are not affected thereby shall continue to be in full force and effect.

SECTION 18. REPEALING CLAUSE. All ordinances, rules, and regulations or parts thereof in conflict with this Ordinance are hereby repealed, provided that the rights that are vested upon the effectivity of this Ordinance shall not be impaired.

SECTION 19. EFFECTIVITY. This ordinance shall take effect fifteen (15) days after its publication in newspaper of general circulation.

ANNEX A: INTERNET PROTOCOL (IP) IMPLEMENTATION PLAN

NAGA CITY PLAN FOR IP CAMERAS INSTALLATION (GOVERNMENT OWNED AND OPERATED)

1. Objectives

  • Enhance peace and order monitoring in crime-prone areas.
  • Improve traffic management in congestion-prone junctions.
  • Strengthen disaster risk reduction by monitoring flood-prone and fire-prone sites.
  • Provide 24/7 surveillance for critical government infrastructure and public congregation areas.
  • Integrate all barangay-level IP Cameras feeds into the future CESAR Command Center, ensuring interoperability.
  • Provide specification standards to ascertain usefulness, connectivity, and interoperability.

2. Coverage (per Barangay & Citywide)
Each of the 27 barangays will have at least:

  • 4 crime-prone area cameras (near schools, markets, terminals, critical alleys).
  • 2 traffic-congestion cameras (major intersections, tricycle/jeepney terminals).
  • 1-2 flood/fire-prone cameras (drainage chokepoints, waterways, densely packed settlements).
  • 1 public facility camera (barangay hall, covered court, plaza).

Citywide strategic locations:

  • Critical infrastructures: City Hall, CeSAR Command Center site, Naga City Hospital, Central Bus Terminal, People’s Mall, City Market.
  • Public congregation areas: Naga Metropolitan Cathedral, Peñafrancia Basilica, Plaza Rizal, Plaza Quezon of Naga, Plaza Quince Martires, and the Central Business Districts (CBDs).
  • Arterial highways: AH26/Maharlika, Roxas Avenue, Magsaysay Avenue, Panganiban Drive. Bridges & critical riverbanks (Naga River; Bicol River).
  • Festival routes (Peñafrancia procession corridors; main parade corridors).

Total Estimate:

  • Barangay-level: ~350 cameras
  • City strategic points: ~250 cameras
  • Grand total: ≈600 high-resolution IP Camera units

3. Technical Specifications (Recommended)

Camera Type Mix:

  • Fixed Dome Cameras (2MP-4MP, 1080p-2K, IR up to 50m)
    • For barangay halls, covered courts, schools, interior streets.
  • PTZ (Pan-Tilt-Zoom) Cameras (4MP-8MP, 20-30x optical zoom, IR up to 200m)
    • For intersections, highways, riverbanks, plazas, and large congregation areas.
  • Thermal/Low-Light Cameras (2MP, IR up to 500m)
    • For flood monitoring (night visibility on river/creek lines).
  • ANPR (Automatic Number Plate Recognition) Cameras (at main city entry/exit points, transport terminals).

Key Features:

  • Resolution: 1080p minimum, 2K pixels preferred (higher for PTZ strategic sites).
  • Weatherproof: IP66/IP777-rated (outdoor use).
  • Power: PoE (Power over Ethernet) preferred; solar + battery for remote.
  • Storage: Local edge storage (SD card 128GB) + centralized server backup.
  • Network: Fiber backbone where feasible, wireless mesh/4G/5G links for barangay cameras.
  • Smart AI Analytics: Motion detection, crowd density alerts, face recognition (future upgrade).

System Integration:

  • Video Management System (VMS): centralized platform at CeSAR with GIS-based mapping.
  • Scalability: able to add barangay-level feeds (uplink to CeSAR via VPN-secured fiber/wireless).
  • Redundancy: mirrored servers, UPS backup, and generator support.

4. Estimated Budget & Phasing

  • Phase 1 (Year 1-2): 100 cameras (CBD, City Hall, Basilica, market, 5 critical junctions).
  • Phase 2 (Year 3-4): 100 cameras (barangay halls, flood-prone zones, schools).
  • Phase 3 (Year 5): 100 cameras (full barangay coverage, outer periphery roads).

Funding Sources: LGU budget (AIP), barangay shares, DILG peace and order funds, DICT smart city grants, PPP with telcos.

5. Communication Links

  • Barangay Integration: Each barangay to have a mini-monitoring station (1-2 screens, linked via VPN to CeSAR).
  • Mobile Access: CeSAR+PSO+PNP+BFP to have secured app-based live view on tablets.
  • Radio Interlink: IP Cameras alerts synchronized with existing handheld radios (UHF/VHF).

ANNEX B: MEMORANDUM OF AGREEMENT WITH THE BARANGAYS

Between the City Government of Naga and the Twenty-Seven (27) Barangays of Naga City

This MEMORANDUM OF AGREEMENT (MOA) is made and entered into this ____ day of _____________, 2025 at Naga City, Camarines Sur, by and between:

THE CITY GOVERNMENT OF NAGA, a local government unit duly organized and existing under the laws of the Republic of the Philippines, with principal offices at City Hall Compound, J. Miranda Avenue, Naga City, represented herein by its City Mayor, HON. MARIA LEONOR G. ROBREDO, hereinafter referred to as the CITY;

-and-

THE BARANGAY GOVERNMENTS OF NAGA CITY, composed of the duly constituted and recognized twenty-seven (27) barangays, each represented herein by their respective Punong Barangay, hereinafter collectively referred to as the BARANGAYS.

The CITY and the BARANGAYS may hereinafter be collectively referred to as the PARTIES.

WHEREAS:

  • The CITY recognizes the importance of ensuring peace and order, traffic management, disaster prevention, and community safety through the establishment of a Citywide Internet Protocol (IP) Cameras Surveillance and Safety Network, to be centrally monitored at the Center for Safety and Resiliency (CeSAR) Command Center;
  • The BARANGAYS, being the frontline units of governance, are vital partners of the CITY in public safety, incident monitoring, and community disaster preparedness, and thus should actively participate in the planning, financing, operation, and maintenance of the IP Cameras system within their respective jurisdictions;
  • The PARTIES mutually agree to establish a framework of shared responsibility and co-financing, allowing IP cameras installed in barangay areas to be linked and monitored by the CeSAR, while also enabling barangay-level monitoring and response capability.

NOW THEREFORE, for and in consideration of the foregoing premises, the PARTIES hereby agree as follows:

ARTICLE I
Purpose
This MOA aims to institutionalize the cooperation between the CITY and the BARANGAYS in the establishment, operation, and sustainability of the Naga City Internet Protocol (IP) Cameras Surveillance and Safety Network, ensuring its effective utilization for peace and order, traffic management, crime prevention, disaster preparedness, and community safety.

ARTICLE II
Obligations of the CITY
The CITY shall:

  1. Install and integrate IP cameras in strategic sites across the 27 barangays;
  2. Provide the central monitoring hub through the CESAR Command Center;
  3. Subsidize the cost of camera acquisition, installation, network connectivity, and initial training;
  4. Ensure interoperability with law enforcement agencies;
  5. Provide technical assistance and periodic upgrading.

ARTICLE III
Obligations of the BARANGAYS
The BARANGAYS shall:

  1. Co-finance the procurement and/or maintenance of IP cameras within their jurisdictions in coordination with the CITY;
  2. Designate trained Barangay Monitoring Personnel trained by the CITY to oversea localized surveillance, coordinate with CeSAR, and respond to incidents at the barangay level;
  3. Allow integration of barangay IP Cameras feeds into the CeSAR Command Center for central monitoring, analysis, and archiving;
  4. Assist in incident verification and investigation by providing ground-level support to authorized law enforcement, peacekeeping, and disaster prevention authorities, when so requested by the CITY;
  5. Ensure continuity of IP Cameras operations by budgeting for electricity, minor repairs, and security of installed equipment.
  6. Promote data privacy and responsible use of IP Cameras footage, consistent with the Data Privacy Act of 2012 (RA 10173).

ARTICLE IV
Joint Responsibilities
The PARTIES shall:

  1. Establish an IP Cameras Operations and Monitoring Protocol to define reporting procedures, escalation of incidents, and coordination during emergencies;
  2. Hold regular quarterly coordination meetings between CeSAR and barangay representatives to assess system performance and update coverage needs;
  3. Develop capacity-building programs for barangay peacekeepers, traffic enforcers, and disaster response teams on how to effectively utilize IP Camera for community safety.

ARTICLE V
Funding
The internet Protocol (IP) Camera Surveillance and Safety Network shall be jointly funded through:

  • Annual appropriations of the CITY, sourced from its general fund and/or special account;
  • Appropriations of the BARANGAYS from their respective Barangay Development Fund (BDF) or other lawful sources;
  • Possible grants, donations, or public-private partnerships secured jointly by the CITY and the BARANGAYS.

ARTICLE VI
Effectivity and Duration
This MOA shall take effect upon signing by the PARTIES and shall remain in force for five () years, renewable upon mutual agreement.

ARTICLE VII
Miscellaneous Provisions

  1. Separability Clause. If any provision of this MOA is declared invalid, the remaining provisions shall continue to be in full force and effect.
  2. Amendments. This MOA may be amended or supplemented by mutual consent of the PARTIES in writing.
  3. Termination. Either party may terminate this MOA for just cause, provided written notice is served to the other party at least ninety (80) days prior to termination.
