Effectivity: Takes effect immediately upon approval.

ORDINANCE NO. 2025-053

AN ORDINANCE AMENDING SECTION 13 OF ORDINANCE NO. 2020-072, OTHERWISE KNOWN AS “PERSONS WITH DISABILITY CODE OF NAGA CITY,” BY EXTENDING THE VALIDITY OF EPWD-ID FROM THREE YEARS TO FIVE YEARS:-

EXPLANATORY NOTE

Section 13 of Ordinance No. 2020-072 provides that ePWD IDS issued by the City Government of Naga shall be valid for three (3) years from the date it is issued and shall be renewed upon its expiration.

Through Administrative Order No. 0001, s. 2021 of the National Council on Disability Affairs, the said council has forwarded that PWD IDs be valid for five (5) years.

Article 7 of the Civil Code of the Philippines commands that administrative or executive acts, orders, and regulations shall be valid only when they are not contrary to the laws or the Constitution. Thus, given that the PWD Code is a local law and the one issued by the NCDA is an administrative order, the Persons with Disability Affairs Office has been constrained to follow the provisions under the ordinance. Currently, the PWD ID that PDAO issues has a validity of three years.

In order to eliminate inconsistencies and so as to provide PWDs of Naga City with the more favorable and longer term of validity for PWD IDs, this ordinance is hereby being proposed for enactment.

BE IT ORDAINED, therefore, by the Sangguniang Panlungsod of the City of Naga, in session duly-assembled, that:

SECTION 1. TITLE. This Ordinance shall be known and cited as the “Five Year ePWD ID Validity Ordinance.”

SECTION 2. AMENDMENT. Section 13 of Ordinance No. 2020-072, otherwise known as the “Persons with Disability Code of Naga City,” is hereby amended by extending the validity of ePWD-ID from three years to five years and, therefore, is now to be read as follows:

SECTION 13. Validity. The ePWD-ID shall be valid for five (5) years from the date it is issued. It shall be renewed upon expiration.

Renewal of ePWD-ID shall be free of charge, provided that the old ePWD-ID is surrendered to the PDAO.”

SECTION 3. REPEALING CLAUSE. All resolutions, ordinances, and executive issuances, or provisions thereof, which are inconsistent with any of the provisions hereof are hereby accordingly repealed, amended and/or modified.

SECTION 4. SEPARABILITY CLAUSE. Should any provision of this ordinance be subsequently declared unconstitutional or ultra vires, the rest of the provisions not so declared shall remain to be in full force and effect.

SECTION 5. EFFECTIVITY CLAUSE. This ordinance shall take effect immediately upon its approval.
