ORDINANCE NO. 2022-013

AN ORDINANCE REVISING SECTIONS 2, 4, 5 AND 6 OF ORDINANCE NO. 2014-051 BY AUTHORIZING RUBY SHELTER DEVELOPMENT CORPORATION TO OPERATE THE TEMPORARY EASTBOUND PUBLIC UTILITY JEEPNEYS AND VANS (PUJV) TERMINAL LOCATED AT THE NAGA CITY CENTRAL BUSINESS DISTRICT II AND RECOGNIZING ITS AUTHORITY TO COLLECT TERMINAL FEES AMOUNTING TO FORTY PESOS (P40.00) PER PUBLIC UTILITY JEEPNEY AND SIXTY PESOS (P60.00) PER PUBLIC UTILITY VAN PER DISPATCH THEREFROM:-

Be it enacted by the Sangguniang Panlungsod of Naga, in session assembled:

SECTION 1. Section 2 of Ordinance No. 2014-051 is hereby revised, now to read as follows:

SECTION 2. The property designated as Temporary Eastbound Public Utility Jeepneys and Vans (PUJV) Terminal shall be operated by Ruby Shelter Development Corporation under a temporary permit to operate and until such time that a permanent Eastbound PUJV terminal shall have been approved by the City Government of Naga.”

SECTION 2. Duties of the Operator of the Temporary Eastbound PUJV Terminal. As the authorized operator of the Temporary Eastbound PUJV Terminal, Ruby Shelter Development Corporation shall have the duty and responsibility of maintaining the safety and orderliness of the Terminal in order to effectively serve public convenience.

SECTION 3. Enforcement of Rules and Regulations. For the proper utilization of the Temporary Eastbound PUJV Terminal, Ruby Shelter Development Corporation shall have the authority to implement rules and regulations as may be necessary to achieve the purpose of PUJV Operation and protect the interest of the riding public.

SECTION 4. Section 4 of Ordinance No. 2014-051 is hereby revised, now to read as follows:

SECTION 4. Terminal Fees. The amount of forty pesos (P40.00) for public utility jeepney, and sixty pesos (P60.00) for public utility van, per dispatch may be collected by the operator of the Temporary Eastbound Terminal as Terminal Fees. Any change in the amount of the Terminal Fees shall not be implemented until after consultations have been conducted with the eastbound public utility jeepney and van drivers/operators and approved by the Sangguniang Panlungsod.

SECTION 5. Section 5 of Ordinance No. 2014-051 is hereby revised, now to read as follows:

SECTION 5. Role of the City Government. To ensure the orderly operation of the Temporary Eastbound PUJV Terminal, the City Government shall perform the following:

  1. The Public Safety Office (PSO) and the Bicol Central Station Administration shall extend the assistance as may be requested by the Terminal Operator in order to maintain safety and order in the facility;
  2. The Sangguniang Panlungsod Committee on Public Utility shall continue to perform the oversight function of the Sangguniang Panlungsod of Naga in the implementation of this Ordinance.”

SECTION 6. To achieve the purpose of this Ordinance, paragraph (a), Section 6 of Ordinance No. 2014-051 is hereby repealed.

SECTION 7. All existing ordinances, rules and regulations or parts thereof, which are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed, modified and/or amended, accordingly.

SECTION 8. EFFECTIVITY: This ordinance shall take effect immediately upon its approval.
