AS AMENDED BY ORDINANCE NO. 2001-086, BY OPENING TWENTY (20) PADYAK FRANCHISES FOR BALATAS LOOBAN AND URBAN POOR PADYAK OPERATORS AND DRIVERS ASSOCIATION (BALUPODA) TO PLY AT USWAG BALATAS, ZONE 5, AND FIVE (5) PADYAK FRANCHISES FOR LOOBAN 2, ZONE 5, ALL IN BARANGAY BALATAS, NAGA CITY, SUBJECT TO CERTAIN CONDITIONS

Summary: Ordinance No. 2020-051, enacted on June 9, 2020 , further amends Ordinance No. 93-049, known as “The Transport and Traffic Code of Naga City”. This amendment specifically opens twenty (20) padyak (pedicab) franchises for the Balatas Looban and Urban Poor Padyak Operators and Drivers Association (BALUPODA) to operate in Uswag Balatas, Zone 5, and five (5) padyak franchises for Looban 2, Zone 5, all within Barangay Balatas, Naga City. The ordinance sets conditions, including requiring a recommendation from the Barangay Council of Balatas , ensuring the terminal is not located near the main road of Balatas , and establishing a passenger fare of Ten Pesos (P10.00) with a 20% discount for students, senior citizens, and persons with disabilities. The Barangay Council of Balatas is responsible for facilitating the drawing of slots and awarding units to qualified applicants.

ORDINANCE NO. 2020-051

AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 93-049, OTHERWISE KNOWN AS “THE TRANSPORT AND TRAFFIC CODE OF NAGA CITY”, AS AMENDED BY ORDINANCE NO. 2001-086, BY OPENING TWENTY (20) PADYAK FRANCHISES FOR BALATAS LOOBAN AND URBAN POOR PADYAK OPERATORS AND DRIVERS ASSOCIATION (BALUPODA) TO PLY AT USWAG BALATAS, ZONE 5, AND FIVE (5) PADYAK FRANCHISES FOR LOOBAN 2, ZONE 5, ALL IN BARANGAY BALATAS, NAGA CITY, SUBJECT TO CERTAIN CONDITIONS:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. Ordinance No. 93-049, otherwise known as the “Transport and Traffic Code of Naga City”, as amended by Ordinance no. 2001-086, is hereby further amended by opening twenty (20) padyak franchises for Balatas Looban and Urban Poor Padyak Operators and Drivers Association (BALUPODA) to ply Uswag Balatas, Zone 5, and five (5) padyak franchises to Looban 2, Zone 5, all in Barangay Balatas, this city, subject to certain conditions, now to read as follows:

“SECTION 134. Registration:

  1. Each padyak for hire shall be allowed to ply only a specific route area which shall be identified according to the area covered by the accredited association.

Subject to the following conditions:

  1. That the franchisee/s must secure a recommendation from the Barangay Council of Balatas;

  2. That the terminal shall not be located near the main road of Balatas; and

  3. The passenger fare shall be Ten Pesos (P10.00) with 20% discount for students, senior citizens and persons with disabilities.”

SECTION 2. – The Barangay Council of Balatas shall facilitate the drawing of slots and in awarding the units to qualified applicants.

SECTION 3. This ordinance shall take effect upon its approval and after publication in a newspaper of local circulation.
