ORDINANCE NO. 2020-050

AN ORDINANCE STRENGTHENING THE INFORMATION AND TECHNOLOGY OFFICE OF NAGA CITY:-

Sponsor: Councilor JOSELITO S.A. DEL ROSARIO, Ph.D.

SECTION 1. DECLARATION OF POLICIES AND OBJECTIVES. This ordinance is enacted pursuant to the declared policy of the State that recognizes the vital role of information and communications technology (ICT) in nation-building, and the government as a model user of ICT shall utilize new electronic means to deliver core public services in order to demonstrate the benefits derived therefrom and to promote the use of such means, as envisioned by RA 8792 (E-Commerce Law) and RA 11032 (Ease of Doing Business and Efficient Government Service Delivery Act).

This will also reinforce the measures implemented by the concerned agencies to minimize the risk of transmission of Covid 19 virus in Naga City. It also seeks to limit non-essential movement and congregation of people consistent with the State of Public Health Emergency declared by President Rodrigo Duterte nationwide.

SECTION 2. SCOPE. This Ordinance seeks to strengthen the Information and Technology Office of the City Government of Naga. In doing so and aside from its normal transactions, its mandate shall now include strengthened collaboration with all offices, departments, units and other offices in the City Government of Naga and its barangays.

Given the rapid and robust development of information and communications technology and amidst the backdrop of the Coronavirus pandemic and probable emergence of infectious diseases, a strengthened and empowered Information and Technology Office of the City Government of Naga is, not only a must, but a necessity as well. Hence this Ordinance.

SECTION 3. – ITO ADMINISTRATIVE DIVISIONS AND SECTIONS. – Aside from its original plantilla positions which include four (4) divisions, namely Systems Development and Maintenance Division, Network and Database Administration Division, Administrative and IT Support Division, a position of at least one (1) System’s Analyst shall now be included in the ITO.

The System’s Analyst shall be primarily responsible in ensuring that an operational hub is established to carry comprehensive on-line transactions for the city and the barangays and that its connectivity is efficiently maintained and updated.

SECTION 4. ORGANIZATIONAL STRUCTURE. The ITO shall have the following organizational structure:

Advisory Board Department Head Administrative Division Systems Development & Maintenance Division Network and Database Administration Division IT Support Division

  1. Review of other third-party applications that are being recommended or offered for use by the City Government to ensure technical soundness, maintainability and integration into the City Government’s own IT system;

  2. Lead the conduct of information dissemination campaign to inform the public of the intent and objectives of this ordinance:

  3. Formulation of other programs to effectively implement this ordinance, particularly on the PWD sector,

(c) The Chair of the Advisory Board and the ITO Head shall regularly update the Sangguniang Panlungsod of the matters taken relative thereto, for its guidance and/or approval, if necessary.

SECTION 7. – SEPARABILITY CLAUSE. If any provision of this Ordinance or the application thereon to any persons or circumstances is held invalid, the remainder of this and the application of such other provisions to other persons or circumstances shall not be affected thereby.

SECTION 8. – REPEALING CLAUSE. – Any provision of existing ordinance, rules and regulations and/or parts thereof inconsistent with the provisions of this ordinance are hereby repealed and/or modified accordingly. Should any portion or provisions of this ordinance be declared unconstitutional or invalid, the other parts or provisions thereof which are not affected thereby shall continue to be in full force and effect.

SECTION 9. – EFFECTIVITY. – This ordinance shall take effect immediately upon its approval.
