Summary: Ordinance No. 2020-045, enacted on May 26, 2020, mandates the waiver of rental fees or cash tickets for all stalls and vendors operating at the Bicol Central Station. This waiver covers the entire duration of the Enhanced Community Quarantine (ECQ). ORDINANCE WAIVING THE RENTAL FEES OR CASH TICKETS ON ALL STALLS AND VENDORS AT THE BICOL CENTRAL STATION DURING THE PERIOD OF THE ENHANCED COMMUNITY QUARANTINE AND EVEN DURING THE PERIOD THEREAFTER FOR STALLS THAT HAVE BEEN ORDERED TO REMAIN CLOSED:-

EXPLANATORY NOTE

Under Proclamation No. 929, series 2020, dated March 16, 2020, President Rodrigo R. Duterte declared a State of Calamity throughout the Philippines due to Corona Virus Disease 2019 (COVID-19). The president, through a Memorandum signed by Executive Secretary Salvador C. Medialdea, dated March 16, 2020, also placed the entire Luzon under an Enhanced Community Quarantine. Pursuant to these directives, all households, including those without suspected cases of COVID-19 exposure, to remain at home to prevent the transmission of the COVID 19 virus. As a consequence, there are businesses that have been ordered closed.

On May 1, 2020, Enhanced Community Quarantine in certain areas of Luzon, including Naga City, was lifted and the General Community Quarantine was imposed. Under this scheme, only a list of business establishments have been allowed to operate.

Given the direct impact of public health emergency to the livelihood and lives of stallholders and vendors at the Bicol Central Station, it is hereby recommended that no cash ticket or rental fee be imposed on them during the period of the Enhanced Community Quarantine (March 16 to April 30, 2020). Meanwhile, those which have been ordered to remain closed during the period of the General Community Quarantine and even the time thereafter must not also be charged of any rental fee or cash ticket as their non-operation is brought about not by their own volition but by prevailing national and/or local directives.

BE IT ORDAINED by the 13th Sangguniang Panlungsod of Naga that:

SECTION 1. WAIVER OF RENTAL FEES AND CASH TICKETS DURING ENHANCED COMMUNITY QUARANTINE. All stalls and vendors at the Bicol Central Station shall not be charged of any rental fee or cash ticket for the entire duration of the Enhanced Community Quarantine.

SECTION 2. CONTINUED WAIVER OF RENTAL FEES AND CASH TICKETS FOR CLOSED ESTABLISHMENTS. Those which have been ordered to remain closed even after the period of the Enhanced Community Quarantine, pursuant to prevailing national and/or local directives, shall not be charged of any rental fee or cash ticket during the time of their non-operation.

SECTION 3. COLLECTION OF RENT. The City Mayor is hereby authorized to set the due date for collection of rental fees or cash tickets.

SECTION 4. This ordinance amend Ordinance No. 2020-025; SECTION 4. This ordinance is effective immediately upon its approval.
