Summary: This ordinance directs the reversion of funds from the Naga River Rehabilitation Development Fund back into the city’s unappropriated balance to cover just compensation and accrued interest for the expropriation of the 20,000 sqm Abella property in Barangay Cararayan. The property will be used for socialized housing following a Writ of Possession issued on November 8, 2018. It took effect immediately upon approval.

ORDINANCE NO. 2019-045

AN ORDINANCE REVERTING CERTAIN AMOUNT AS MAYBE NECESSARY FROM THE NAGA RIVER REHABILITATION DEVELOPMENT FUND TO UNAPPROPRIATED BALANCE, AND APPROPRIATING THE SAME TO COVER THE PAYMENT FOR JUST COMPENSATION AND LEGAL INTEREST FROM THE ISSUANCE OF THE WRIT OF POSSESSION ISSUED BY RTC BRANCH 61 DATED NOVEMBER 8, 2018 WITH RESPECT TO THE EXPROPRIATION CASE FILED BY THE NAGA CITY GOVERNMENT ON THE ABELLA PROPERTY WITH AN AREA OF 20,000 SQUARE METERS LOCATED IN SALUNGUIGUI, BARANGAY CARARAYAN, NAGA CITY, NOW USED AS A SOCIALIZED HOUSING SITE:-

Be it ordained by the Sangguniang Panlungsod of Naga, that:

SECTION 1. It is hereby reverted to unappropriated balance certain amount as maybe necessary from the Naga River Rehabilitation Development Fund, and appropriated to cover the payment for just compensation and legal interest from the issuance of the Writ of Possession issued by RTC Branch 61 dated November 8, 2018 with respect to the expropriation case filed by the Naga City Government on the Abella Property with an area of 20,000 square meters located in Salunguigui, Barangay Cararayan, Naga City, now used a a Socialized Housing Site;

SECTION 2. This ordinance shall take effect upon its approval.

ENACTED: July 2, 2019
