ORDINANCE SUMMARY :
This proposed ordinance prohibits owners or handlers from allowing livestock and other farm animals to roam, stray, or remain unattended along public spaces, roads, bridges, sidewalks, and government-owned areas in Naga City. It establishes a legal mechanism for the apprehension and impoundment of stray animals, lays down progressive financial penalties for violators, specifies owner liabilities and duties for animal containment, and delegates enforcement responsibilities to designated city offices and barangay officials
ORDINANCE HIGHLIGHTS :

COVERED ANIMALS: Applies to cattle/cows, carabaos, goats, sheep, pigs, horses, ducks, geese, domestic fowl, and other similar farm animals capable of causing traffic obstruction or public nuisance. Wildlife/protected species fall under the City ENRO.

PROHIBITED ACTS: Makes it unlawful to allow livestock to roam unattended on public roads, highways, alleys, parks, and drainage easements; tie or tether animals where they obstruct traffic; cause willful or negligent damage to public infrastructure or private property; abandon animals; or refuse to secure animals after notice.

IMPOUNDMENT PROCEDURES: Stray animals will be immediately apprehended and impounded by authorized city or deputized barangay personnel. Owners can claim their animals by presenting proof of ownership, paying applicable impounding fees, maintenance/food expenses, and penalties, and complying with City Veterinary Office requirements. Unclaimed animals are subject to disposition via public auction or other lawful means under existing regulations.

PENALTIES:

First Offense: Fine of One Thousand Pesos (₱1,000.00) plus a warning.

Second Offense: Fine of Two Thousand Pesos (₱2,000.00) plus impounding expenses.

Third and Subsequent Offenses: Fine of Three Thousand Pesos (₱3,000.00).

Note: Each animal found roaming constitutes a separate violation.

CIVIL LIABILITY: Payment of penalties does not exempt animal owners from civil liabilities for any injuries, accidents, or property destruction caused by their animals.

IMPLEMENTING OFFICES: Jointly implemented by the City Veterinary Office, City Abattoir, City ENRO, City Engineering Office, Public Safety Office, and Barangay Officials.
