This ordinance establishes the “Naga City Public Access Defibrillation and AED Ordinance of 2026.” Designed to be fully self-executing, it mandates the procurement, installation, registration, and maintenance of Automated External Defibrillator (AED) units in high-density environments, business establishments, institutions, and large-scale events with a capacity or personnel count of at least 100. The policy aims to combat Sudden Cardiac Arrest (SCA) by deploying user-friendly medical technology alongside Cardiopulmonary Resuscitation (CPR) before emergency medical services arrive, dramatically increasing survival rates in the city.

- MANDATORY AED PLACEMENT BY THRESHOLD: Requires all covered public and private entities with a capacity, workforce, or regular footprint of at least 100 people—including schools, malls, places of worship, offices, BPOs, gyms, hotels, and medical clinics—to install and maintain at least one functional AED unit. Large multi-story buildings must distribute additional units to ensure retrieval within a 3-minute walking radius.
- REQUIREMENT FOR BIG-SCALE EVENTS: Organizers of temporary public or private events with an expected attendance of 100 or more (e.g., concerts, marathons, rallies) must natively include a functional AED and a trained responder in their on-site emergency kits as a mandatory condition for securing a Mayor’s Permit.
- 90-DAY COMPLIANCE AND EARLY ADOPTER INCENTIVE: Grants covered establishments a 90-calendar-day compliance window to install and register their units. Entities that successfully register within this window receive a one-time 5% local tax discount based on the AED’s purchase price, credited to the next business permit renewal cycle.
- REGISTRATION AND ANNUAL RENEWALS: Mandates direct registration of all AED units with the City Disaster Risk Reduction and Management Office (CDRRMO). Registration is free in the first year and carries a annual renewal fee thereafter. Clinical training/demonstration devices are exempt from fees if explicitly labeled for training use only.
- MANDATORY STAFF TRAINING: Requires covered entities to maintain at least two (2) certified personnel per shift (e.g., security, front desk staff) trained in Basic Life Support (BLS) and AED utilization, with certifications refreshed every two years.
- RESPONDER PROTECTION CLAUSE: Includes a Good Samaritan safeguard protecting any layperson or first responder from civil or criminal liability for injuries, complications, or death resulting from emergency CPR or AED deployment, provided they acted in good faith and without gross negligence.
- POST-EVENT PROTOCOL & DATA LOGGING: Requires anyone who deploys an AED in an emergency to immediately alert the Naga City Emergency Response system and mandates that administrators submit an incident log to the CDRRMO and City Health Office (CHO) within 24 hours for data extraction and statistical monitoring.
