This ordinance provides structural, digital, and legal safeguards for app-based delivery riders and taxi drivers within Naga City to protect them from physical threats, financial fraud, and unfair performance penalties.
Highlights of the Ordinance
- PROTECTION FOR TAXI DRIVERS: Grants taxi drivers the right to safely eject and discharge passengers at designated secure emergency drop-off zones (established by the Public Safety Office and local police) if the passenger is heavily intoxicated, violent, or poses a safety threat. Also requires passengers using taxi-hailing apps to present a valid government or school ID before starting a trip.
- PROTECTION FOR DELIVERY RIDERS: Requires customers placing Cash-on-Delivery (COD) orders for high-value goods (exceeding Php 1,000.00) to present a valid government-issued or school ID. Couriers are authorized to withhold delivery without incurring performance penalties or negative ratings if the customer fails or refuses to verify their identity.
- JOINT SAFETY MEASURES:
- Mandatory Rider Spaces: Large commercial establishments must provide free, covered waiting lounges with motorcycle parking, mobile charging stations, and drinking water for riders.
- Weather-Triggered Automation: Platforms must automatically suspend operations or lift speed performance metrics during PAGASA extreme weather warnings or hazardous heat index alerts.
- Equipment Subsidies: Platforms must subsidize or provide essential protective gear such as reflective vests, standard helmets, and insulated weather-proof delivery boxes.
- No-Penalty Cancellation Zone: Drivers have the right to cancel or reject bookings to unlit, high-crime, or poorly accessible locations at night without algorithmic penalties.
