This ordinance permanently institutionalizes the “Naga City Road Obstruction Prevention and Safe Traffic Flow Ordinance of 2026” within the city’s transport framework, optimizing local road clearing and safety programs to protect motorists and pedestrians safely. Operating as a road safety initiative that sets specific engineering and operational baselines for public thoroughfares, this program eliminates unauthorized physical obstructions through structured civic compliance. The system pairs municipal leadership with local barangays and enforcement agencies to prevent traffic hazards, laying down distinct prohibitions, mandatory engineering evaluations, penalty clauses, and summary removal mechanisms.
Highlights of the Ordinance
- BAN ON UNAUTHORIZED ROAD OBSTRUCTIONS. Prohibits the unauthorized construction, placement, or maintenance of speed humps, roadblocks, barricades, bollards, chains, ropes, concrete blocks, and similar structures on any public road.
- PROTECTION FOR VULNERABLE ROAD USERS. Aims to ensure the safe and efficient movement of motorists, cyclists, pedestrians, commuters, and emergency vehicles, paying special attention to vulnerable light vehicle users like motorcycle and bicycle riders.
- ENGINEERING STANDARDS AND EVALUATION. Mandates that request for traffic-calming devices must undergo a traffic engineering study, road safety assessment, strict compliance with Department of Public Works and Highways (DPWH) standards, and proper government approval.
- SUMMARY REMOVAL OF HAZARDS. Grants the City Mayor, through the City Engineer’s Office, Public Safety Office, and law enforcement agencies, the authority to immediately remove unauthorized obstructions without prior notice if they pose an immediate danger or impede emergency response.
- PENALTIES FOR VIOLATORS. Imposes progressive fines and mandatory removal of obstructions, scaling from a P2,000.00 fine for the first offense, P3,000.00 for the second offense, up to P5,000.00 and potential imprisonment of up to six months for third and subsequent offenses.
- REINFORCEMENT OF EXISTING ROAD CLEARING. Complements and strengthens City Ordinance No. 2022-064-A (the Road Clearing for Public Safety and Convenience Ordinance) by defining clear responsibilities for the city’s 27 barangays and establishing administrative liabilities for public officials.
