PROPOSED ORDINANCE: Healthy Food and Beverage Standards Ordinance of Naga City

Summary/Highlights

Title of Proposed Legislation/Author/Sponsor:
AN ORDINANCE ESTABLISHING THE HEALTHY FOOD AND BEVERAGE STANDARDS FOR CITY-FUNDED PROCUREMENT, PROGRAMS, ACTIVITIES, AND OFFICIAL PROVISION IN NAGA CITY, AND FOR OTHER PURPOSES

Author/s : Hon. Jefson Romeo B. Felix
Date Proposed : August 10, 2026

ORDINANCE SUMMARY :
The ordinance establishes an evidence-informed framework governing food and beverages purchased, served, distributed, or officially provided using public funds in Naga City. Following the veto of earlier iterations, this revised and consolidated measure introduces objective, verifiable standards, fair procurement processes, clear classifications, and defined exceptions to advance public health and preventive nutrition while supporting local livelihoods, supplier participation, and operational feasibility.

ORDINANCE HIGHLIGHTS :

  • POLICY AND OBJECTIVES: Establishes objective and workable standards for city-funded meals, snacks, beverages, and welfare food packages to promote preventive health, safeguard public funds, ensure fair competition, and respect private livelihoods.

  • DEFAULT BEVERAGE STANDARD: Mandates Potable Drinking Water as the default beverage, which must remain visibly available during official provisions. Sweetened beverages are prohibited from routine official provision, and energy/alcoholic beverages are completely barred.

  • PREPARED MEALS & SNACKS: Requires routine complete meals to include precise minimum portions of staples, proteins, vegetables, and fruits based on official nutritional frameworks (such as DOST-FNRI guidelines). Sets strict eligible criteria for routine snacks and light refreshments.

  • WELFARE & SPECIALIZED PACKAGES: Classifies welfare food distributions into general household assistance, nutrition/health-specific, Christmas/festive, and emergency/disaster packages. Specialized programs are governed by designated Authoritative Standards.

  • FAIR NOTICE & PROCUREMENT PLANNING: Requires all technical specifications and requirements to be objectively verifiable, pre-disclosed before solicitation or purchase, and supported by preliminary market scoping. Prohibits retroactive standards or unannounced criteria.

  • EXCEPTIONS & GOVERNANCE: Permits departures from routine standards under explicit circumstances (such as medical needs, emergencies, or cultural/festive occasions) subject to proper written approvals. Establishes joint operational responsibilities across key city offices (CPNO, CHO, CPO, etc.) and mandates a first-year implementation review and operational readiness assessment.
