ORDINANCE SUMMARY :
This amendatory ordinance updates City Ordinance No. 2018-017 to align Naga City’s drug-free workplace policies with Section 36(d) of Republic Act No. 9165 (Comprehensive Dangerous Drugs Act of 2002) and Dangerous Drugs Board (DDB) Regulation No. 13, series of 2018. It refines the scope of covered workers, reorganizes the Naga City Government Drug-Free Workplace Committee, details duties and procedures for random and for-cause drug testing (specifying the Naga City General Hospital as the authorized testing facility), deletes obsolete provisions, and ensures adherence to the Data Privacy Act.

ORDINANCE HIGHLIGHTS :

  • SCOPE & COVERAGE: Covers all officials and employees of the City Government of Naga—elective, appointive, regular, permanent, temporary, and casual regardless of rank or salary—as well as employment applicants, with provisions integrated into their employment contracts.

  • RESTRUCTURED COMMITTEE: Reconstitutes the Naga City Government Drug-Free Workplace Committee, chaired by the City Mayor and co-chaired by the Executive Director of the NCDDB, with key city officials (including the City Administrator, Legal Officer, Health Officer, Budget Officer, NCGH Chief of Hospital, PSO Executive Director, CSWD Officer, NACILGUEA President) and the City Human Resources Management Officer acting as the secretariat.

  • COMMITTEE FUNCTIONS: Formulates and reviews policies, oversees drug testing and advocacy programs, administers the Employee Assistance Program (EAP), adjudicates violations under Civil Service rules, and submits regular DDB reports compliant with the Data Privacy Act.

  • PRE-EMPLOYMENT REQUIREMENTS: Mandates drug tests for all job applicants at their own expense, with drug test certificates issued by the Naga City General Hospital or accredited centers attached to the Revised CSC Form 211. Applicants testing positive are denied entry.

  • SUBSEQUENT & FOR-CAUSE TESTING: Requires mandatory random drug tests for incumbent employees funded by the city. Outlines strict triggers for “for-cause” testing, including returning workers from rehab/CBDRP, observed impairment, or aberrant behavior.

  • DELETIONS & STREAMLINING: Amends specific sections by removing outdated subsections (such as deleting items in Sections 13 and 14) and deleting Section 16 entirely to streamline local enforcement with current national standards.
