The system pairs municipal leadership with local enforcement units and terminal management to prevent exploitation and extortion, laying down distinct prohibitions, progressive penal clauses for violators and complicit drivers, and clear enforcement mechanisms.
Highlights of the Ordinance
- BAN ON UNAUTHORIZED DISPATCHERS. Prohibits unauthorized individuals, callers, or “barkers” from operating within the Bicol Central Station (BCS) and other transport terminals in Naga City to stop aggressive solicitation and public nuisance.
- PROTECTING COMMUTERS FROM FRAUD. Aims to safeguard thousands of daily passengers, tourists, and transport operators from harassment, theft, deception, and unfair competition caused by colorum dispatching systems.
- PENALTIES FOR VIOLATORS. Imposes fines, community service, or imprisonment for unauthorized dispatchers, escalating from a five hundred peso fine (P500.00) or 8 hours of community service for the first offense, up to stricter penalties for subsequent infractions.
- LIABILITY FOR COMPLICIT DRIVERS. Penalizes public utility vehicle (PUV) drivers and operators who pay, employ, or tolerate unauthorized dispatchers, starting with a one thousand peso (P1,000) fine and leading to potential suspension of local transport accreditation.
- ADMINISTRATIVE COMPROMISE AND TICKETING. Integrates enforcement with the city’s citation ticket system, allowing apprehended violators to settle progressive administrative compromise fines within seventy-two hours before cases are forwarded to the City Prosecutor’s Office.
- JOINT ENFORCEMENT AND UNIFORMED DISPATCHERS. Tasks the Public Safety Office, the Bicol Central Station Public Safety and Security Division, and the Naga City Police Office with joint implementation, while mandating legitimate dispatchers to wear official uniforms and display IDs.
