This revised proposed ordinance replaces a previous proposed ordinance to align with new LTO directives regarding motorcycle mufflers. It shifts from a total ban on modifications to a regulated approach based on objective sound limits. The measure aims to reduce noise pollution by prohibiting “open pipes,” establishing noise-sensitive “Quiet Zones,” and using a decibel-based testing system to ensure enforcement is fair and scientific rather than subjective.

Highlights of Proposed Ordinance

  • Objective Noise Standard: Sets a maximum allowable noise level of 99 decibels (dB) for all motorcycles, measured using a sound level meter at a specific distance and engine speed.

  • Prohibition of Open Pipes: Explicitly bans “open-pipe” mufflers and those without functional silencers or baffles.

  • Strict Quiet Zones: Designates areas near hospitals, schools, and residential zones between 9:00 PM and 6:00 AM where noise regulations are more strictly enforced.

  • Citizen Reporting: Establishes a system where residents can report habitual offenders by submitting video or audio evidence to the Public Safety Office (PSO).

  • Free Testing Period: Includes a grace period where motorcycle owners can voluntarily visit the PSO Testing Center for a free noise check without fear of apprehension.

  • Graduated Penalties: Fines range from ₱1,000.00 for a first offense to ₱5,000.00 and vehicle impounding for a third offense.

  • Public Awareness: Mandates a city-wide information campaign involving motorcycle dealers, repair shops, and barangay halls to educate the public on the new standards.
