PROPOSED LOCAL LEGISLATION

HIGHLIGHTS

• Goal: To establish a comprehensive, rights-based program aligned with national law (RA 11166) to achieve a vision of zero new STI/HIV transmissions, zero AIDS-related deaths, and zero discrimination.
• Key Policies: The ordinance mandates the promotion of universal access to prevention, treatment, and support services. It explicitly aims to eliminate stigma and discrimination and protect the human rights of people living with HIV (PLHIV).
• Voluntary Testing: It strictly prohibits compulsory STI or HIV testing and requires all testing to be confidential and voluntary.
• Treatment and Prevention: It mandates the provision of Antiretroviral Therapy (ART) and ensures that Pre-Exposure Prophylaxis (PrEP) and Post-Exposure Prophylaxis (PEP) are provided free of charge to key populations.
• Implementation: It creates the Naga City Multi-Sectoral STI, HIV, and AIDS Council (NMSHAC), chaired by the City Mayor, as the primary policy-making and coordinating body.
• Penalties: It imposes fines and imprisonment for prohibited acts, such as forcing a person to undergo a test or violating confidentiality.
