AN ORDINANCE PROHIBITING CONTRACTORS OF DEFECTIVE PROJECTS IN NAGA CITY AND THEIR KEY TECHNICAL PERSONNEL FROM PARTICIPATING IN ANY PROCUREMENT ACTIVITY OF THE CITY GOVERNMENT IF THEY FAIL TO RECTIFY THE DEFECTS OR PREMATURE DETERIORATION OF THEIR PROJECTS. AND FOR OTHER PURPOSES.

This is an ordinance that establishes accountability measures for defective infrastructure projects in Naga City by banning non-compliant contractors and their key technical personnel from participating in future city procurement activities.

Highlights:
  • Purpose: The ordinance aims to promote good governance and accountability in government procurement and ensure the durability and safety of public infrastructure.
  • Prohibited Repair Method: For concrete and asphalt pavements, the only acceptable method for rectifying defects (like cracking, scaling, or spalling) during the Defects Liability Period (DLP) or Warranty Period is the Removal and Replacement of the affected slab or section; patching, sealing, or overlays are strictly prohibited.
  • Grounds for Ban: A contractor and its Key Technical Personnel are disqualified and banned from future procurement if they fail to mobilize for rectification within thirty (30) calendar days, fail to complete rectification within ninety (90) calendar days, or persist in using prohibited repair methods (patching).
  • Scope of the Ban: The ban applies to the contracting entity, its Authorized Managing Officer (AMO) and Board of Directors, and the Key Technical Personnel (Project Managers, Engineers), preventing the personnel from being proposed in any other future bid.
  • Penalty: In addition to the ban, the City Government will automatically forfeit the Warranty Security (Retention Money or Special Bank Guarantee) to fund the rectification.
