AN ORDINANCE AMENDING ORDINANCE NO. 2022-036, OTHERWISE KNOWN AS THE “2022 REVISED NAGA CITY CHILDREN’S WELFARE CODE,” TO ALIGN ITS FUNDING PROVISION WITH REPUBLIC ACT NO. 9344 OTHERWISE KNOWN AS THE “JUVENILE JUSTICE AND WELFARE ACT”

Key Points:

  • Purpose: The ordinance seeks to clarify that the 1% allocation from the National Tax Allocation (NTA) for the Naga City Council for the Welfare and Protection of Children (NCCWPC) is not only for strengthening the council but also for implementing its programs, projects, and activities The previous version of the city ordinance made a distinction that was not present in R.A. No. 9344
  • Legal Basis: The amendment is based on Section 15 of R.A. No. 9344, which mandates that 1% of the internal revenue allotment of barangays, municipalities, and cities be allocated for the programs of the Local Council for the Protection of Children (LCPC). The ordinance also references Department of the Interior and Local Government (DILG) Memorandum Circular No. 2021-039, which affirms that the 1% allocation is a minimum and can be increased
  • Funding and Implementation: The disbursement of the fund will be made by the city government through its departments and offices that implement children-related programs. The amount allocated for the NCCWPC and its programs must not be less than 1% of the National Tax Allocation.
  • Planning and Integration: The City Accountant’s Office (CAO), in coordination with the NCCWPC and relevant city departments, will prepare a plan and investment program for children. These plans will be integrated into the city’s Comprehensive Development Plan and Local Development Investment Program, which will then serve as the basis for the Annual Investment Program (AIP) and Annual Work and Financial Plan (AWFP).

Effectivity: The ordinance will take effect upon its approval.
