PROPOSED LOCAL LEGISLATION

ORDINANCE REQUIRING A PROJECT FEASIBILITY STUDY REPORT FOR ALL PUBLIC INFRASTRUCTURE PROJECTS FUNDED OR EXECUTED BY THE CITY GOVERNMENT OF NAGA AND ANY OF ITS BARANGAYS

Purpose

This ordinance requires the submission of a Project Feasibility Study Report for all significant public infrastructure projects funded or executed by the City Government of Naga and its barangays. The goal is to ensure projects are necessary, well-planned, and justified before receiving budget appropriation.

Scope and Exemptions

  • Coverage: The ordinance applies to all proposed public infrastructure projects funded by the City of Naga or any of its barangays, including those financed through loans or grants.
  • Exemptions: A report is not required for:
    • City projects with a cost below ₱300,000.004.
    • Barangay projects with a cost below ₱100,000.005.
    • Projects involving repair, rehabilitation, or maintenance.
    • Projects certified as urgent for public safety by the Office of the City Mayor.

Process and Timeline

  1. Submission: The project proponent must prepare the Feasibility Study Report and submit it to the Office of the City Mayor at least thirty (30) days before the project’s official proposal.
  2. Mayor’s Review: The City Mayor may approve or disapprove the submitted report.
  3. Budget Appropriation: The Sangguniang Panlungsod will not entertain any budget requests for a covered project unless this requirement has been met.

Report Contents

The Project Feasibility Study Report must justify the project’s necessity and include the following details11:

  • Nature of the project
  • Identified problems or issues to be addressed 
  • Hazard and risk assessments
  • Expected outcomes upon completion
  • Post-project monitoring and maintenance requirements
  • Alternative measures if the project is disapproved
  • Cost implications
  • Target beneficiaries
  • Project duration

The report must be signed by the head of the concerned office21.

Public Participation

  • Transparency: The report must be posted on the official website of the City Government of Naga within 48 hours of its submission to the Mayor’s Office. It must be readable and downloadable free of charge.

Public Feedback: The public is encouraged to provide feedback, critiques, recommendations, support, or opposition to the proposed project. All public comments will be noted by the proponent and the Mayor’s Office.
