AN ORDINANCE REGULATING THE USE OF DRONES AND PROHIBITING THE FLYING OR DEPLOYMENT OF ANY UNREGISTERED AND UNAUTHORIZED DRONES IN AREAS DECLARED AS NO-FLY ZONES FOR SAFETY AND SECURITY CONSIDERATIONS, PROVIDING PENALTIES FOR VIOLATIONS, AND FOR OTHER PURPOSES:
  • Purpose: The ordinance aims to regulate the use of drones to ensure public safety and security. It addresses concerns that unregulated drone use can compromise safety, disrupt peace, interfere with emergency operations, and pose risks to sensitive locations. It also notes that unauthorized drone surveillance could violate the Data Privacy Act of 2012.
  • Registration: All drones operating within the City of Naga must be registered with the city government. No-Fly Zones: The city government is authorized to declare “no-fly zones.” These may include areas near government buildings, schools, hospitals, public gatherings, and critical infrastructure. Flying a drone in a no-fly zone requires prior written authorization.
  • Prohibited Acts: It is illegal to fly an unregistered or unauthorized drone, operate a drone in a no-fly zone without permission, endanger public safety, invade privacy, or interfere with emergency operations.
  • Penalties: Violations are subject to fines and confiscation of the drone.
    • First offense: A fine of P1,000.00 and confiscation of the drone.
    • Second offense: A fine of P3,000.00 and confiscation of the drone.
    • Third and subsequent offenses: A fine of P20,000.00, confiscation of the drone, and possible imprisonment of not less than five (5) days but not more than thirty (30) days12.
