AN ORDINANCE REGULATING THE ACTIVITIES AND SERVICES OF MINORS IN THE CITY OF NAGA: –

Enacted: September 27, 1989
This ordinance regulates the activities and services performed by minors in Naga City, aligning with the Child and Youth Welfare Code (P.D. 603). It aims to organize, supervise, and guide minors engaged in informal labor within public and semi-public spaces.
  • Definition of Minors:
    • Persons under 18 years old
    • Includes those roaming public spaces or offering services for a fee
  • Covered Activities:
    • Market portering
    • Car watching and cleaning
    • Car washing
    • Shoe shining
    • Vending cigarettes, newspapers, bags, and similar items
  • Organizational Requirements:
    • Minors must be registered with the Boy Scouts or Girl Scouts of the Philippines
    • Coordination with the Concerned Group for Street Children and City INP Station Command
    • Assigned to a troop under adult supervision
    • Must wear ID cards or identifying insignia during service
  • Fee Schedule:
    • Market portering: ₱1.00 for ≤20kg, ₱0.10/kg for excess
    • Car watching/cleaning: ₱1.00/hour
    • Car washing: ₱3.00–₱5.00 depending on vehicle size
    • Shoe shine: ₱3.00/pair (ordinary), ₱6.00/pair (boots)
    • Vending: Prices must not exceed prevailing retail rates
  • Designated Activity Areas:
    • Portering: Markets, terminals, nearby vicinities
    • Car services: Parking areas (e.g., Gen. Luna to Zamora St.), private properties
    • Vending/shoe shine: Designated areas, not sidewalks or downtown streets
  • Implementation Bodies:
    • Camarines Sur Boy Scout Council
    • Girl Scouts of the Philippines, Naga City Council
    • Concerned Group for Street Children
    • City INP Station Command
    • Department of Social Welfare and Development (DSWD)
  • Funding:
    • Charged to the city’s annual appropriation under “Aid to Naga City Street Children”
  • Penalties:
    • Violators confined at Lingap Center for one week for rehabilitation

ORDINANCE NO. 89-061

AN ORDINANCE REGULATING THE ACTIVITIES AND SERVICES OF MINORS IN THE CITY OF NAGA: –

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. – TITLE OF ORDINANCE. – This Ordinance shall be known as “The Organized Services of Minors Ordinance of the City of Naga”;

SECTION 2. – SCOPE OF ORDINANCE. – The provisions of this ordinance shall govern, control, direct, regulate and supervise the activities and services of minors in the City of Naga, in line with the purposes of P.D. 603, otherwise known as the “Child and Youth Welfare Code”;

SECTION 3. – DEFINITION OF TERMS. – Words and Phrases as used in the ordinance:

a. MINORS shall refer to any persons under 18 pears of age who either roam the city streets and public places without any purposes and/or who engage in activities and services for as fee;

b. ACTIVITIES AND SERVICES FOR A FEE would include but not limited to, watching your cars, market portering, car washings, shoe shine, vending cigarettes, newspapers, bags and similar items, and like activities in return for a certain sum of money;

c. PUBLIC OR SEMI-PUBLIC PLACES refer to markets, plazas, parking areas, terminals, gasoline stations, and the like, which are not otherwise prohibited by any law or ordinance.

SECTION 4. – The activities and services of minors in the city of Naga are hereby regulated as follows:

a. All minors in the City of Naga shall be organized before they can engage in activities and services for a fee;

b. He shall be registered with the Boy Scouts of the Philippines, Camarines sur Council or the Girl Scouts of the Philippines, Naga City Council thru the concerned Group for Street Children and CITY INP Station Command;

c. Upon becoming a member, the minor shall be assigned to a Boy Scout or Girl Scout Troop as the case maybe under an adult leader under whom he shall be trained the boy or girl scouting activities and programs including proper guidance in engaging in the activities and services for a fee;

d. The minors under the guidance of the concerned leaders shall be organized according to areas of activities and services and shall perform such activities and services dull identified by an ID card or any identifying mark/ensignia or the like;

e. The minors shall not insist on rendering the activities and services for a fee if the prospective customer refuses to engage their services;

f. The following fees are hereby prescribed for the services rendered:

(f-1)                 Market porteringP 1.00 for 20 kilos or less in weight and an additional of P 0.10 for every kilo in excess of 20 kilos.
(f-2)Watching and cleaning carP 1.00 per hour
(f-3)Car washingP 3.00 for bantam carP 4.00 for light carP 5.00 for heavy car
(f-4)Shoes ShineOrdinary – 3.00 per pairBoots – 6.00 per pair
(f-5)Retail prices of cigarettes, bags, newspapers and the likeShall not go beyond the current prevailing prices.

 

g. the areas of activities shall be limited to the following:

(g-1)          PorteringIn the market, bus and jeepney terminals and in their nearby vicinities;
(g-2)Watching and rug cleaning carIn parking areas; (Gen. Luna from corner Prieto St., to Zamora St.);
(g-3)Car WashingIn private properties and/or designated areas;
(g-4)Shoe Shine, vending cigarettes, bags, newspapers and the likeIn designated areas but not along sidewalks and streets in downtown Naga.

 

SECTION 5. – For this purpose and to ensure the effective implementation of the ordinance, the Camarines Sur Boy Scout Council, the girl Scout of the Philippines, Naga City Council, the Concerned Group for Street Children, and the City INP Station Command and The Department of Social Welfare and Development are hereby authorized to coordinate among themselves and shall promulgate rules and regulations and/or guidelines to effectively implement this ordinance upon its approval.

SECTION 6. – Expenses for the implementation of this program shall be charged to the annual appropriation of the City under the aid to Naga City Street Children;

SECTION 7. – Any minor who violates this ordinance shall be punished by a confinement at the Lingap Center for one (1) week for rehabilitation purposes;

SECTION 8. – This ordinance shall take effect upon its approval.
