Summary: This ordinance revokes Ordinance No. 2018-014, which had temporarily designated portions of General Luna and Elias Angeles Streets surrounding Plaza Rizal for a trade fair by NDC Management Event.

ORDINANCE NO. 2018-061-A 

AN ORDINANCE REVOKING ORDINANCE NO. 2018-014, ENTITLED: “AN ORDINANCE TEMPORARILY WITHDRAWING FROM PUBLIC SERVITUDE PORTION OF GENERAL LUNA AND ELIAS ANGELES STREETS SURROUNDING PLAZA RIZAL FROM AUGUST 15 TO SEPTEMBER 30, 2018, AND GRANTING THE NDC MANAGEMENT EVENT A PERMIT TO HOLD A TRADE FAIR THEREON FROM AUGUST 15 TO SEPTEMBER 30, 2018, SUBJECT TO CERTAIN TERMS AND CONDITIONS”, DUE TO CERTAIN REASONS:

Be it ordained by the Sangguniang Panlungsod of Naga, that:

SECTION 1. – Ordinance No. 2018-014, entitled: “AN ORDINANCE TEMPORARILY WITHDRAWING FROM PUBLIC SERVITUDE PORTION OF GENERAL LUNA AND ELIAS ANGELES STREETS SURROUNDING PLAZA RIZAL FROM AUGUST 15 TO SEPTEMBER 30, 2018, AND GRANTING THE NDC MANAGEMENT EVENT A PERMIT TO HOLD A TRADE FAIR THEREON FROM AUGUST 15 TO SEPTEMBER 30, 2018, SUBJECT TO CERTAIN TERMS AND CONDITIONS”, is hereby revoked due to the following reasons:

  1. The items sold do not fall within the purview of “trade fair” as defined in City Ordinance No. 2009-062 declaring Plaza Rizal as “hallowed ground”;
  2. The spaces occupied by the row of stall around Plaza Rizal are too big; occupying already portions of Elias Angeles and General Luna Streets, and the adjoining sidewalks, obstructing both vehicular and pedestrian traffic around the plaza. This is, in fact, violative of Section 1 (16) of the subject Ordinance 2018-014;
  3. The obstructive stalls built around Plaza Rizal have unceremoniously diminished the plaza’s supposed “hollowed” character, and the over-all aesthetics of the plaza, considering the unsightly “tiangge” that it has turned out to be;
  4. It appears that the organizer did not prioritize local industries supported by the city government, which should be preferred over those coming from other areas;
  5. Vendors already use their stalls as sleeping areas. This is in violation of Section 1(14) of Ordinance 2018-014, and is a ground for revocation of permit;
  1. The ordinance granting permit prohibited vending within six (6) meters from corners. Per inspection made, this was already violated, and can already be made as basis for permit revocation;

SECTION 2. This ordinance shall take effect upon its approval.
