ORDINANCE NO. 95-069
AN ORDINANCE DECLARING ILLEGAL THE PUTTING OF OBSTRUCTIONS TO LINE AND GRADE SETBACKS FOR COMMERCIAL AND RESIDENTIAL BUILDING IN THE URBAN DISTRICT OF NAGA CITY AND PROVIDING PENALTIES THEREFORE:

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:
SECTION 1. – STATEMENT OF POLICY. – It is the policy of the City Government of Naga, in line with the principle and powers laid down under the general welfare clause and of other existing laws, that it may require buildings and/or establishments to set back its construction or provide reasonable space immediately fronting their buildings and abutting a road or street for the purpose of parking of motor vehicles and other uses for the community.
SECTION 2. – It is therefore declared obligatory upon all buildings, whether now existing or still to be constructed, fronting roads/streets, to place, set up, or provide any obstruction or place objects, which shall in any ay impede the use of the parking space.
SECTION 3. – it shall be illegal for anybody, including building owners of establishment fronting roads/streets, to place, set up, or provide any obstruction or place objects, which shall in any way impede the use of the parking space.
SECTION 4. – PENALTY. – For the violation of the foregoing prohibition, the offender shall suffer for the first offense the fine of Five Hundred (P500.00) Pesos; for the second offense a fine of One thousand (P1,000.00) Pesos and/or imprisonment of no less than fifteen (15) days but no more than thirty (30) days; and a third offense, a fine in the amount of Two Thousand (P2,000.00) Pesos and/or for a period of no less than thirty one (31) days but not more than six (6) months, all at the discretion of the courts.
If the violator is a firm or establishment, then the owner or manager shall be held guilty for the violation.
SECTION 3. – EFFECTIVITY. – This ordinance shall take effect after approval.
